La medida de aseguramiento privativa de la libertad y su incidencia en la presunción de inocencia en el sistema penal acusatorio colombiano

Resumen
El presente documento tiene un fin específico y es realizar un estudio bibliográfico acerca
de la prevalencia entre la presunción de inocencia y la medida de aseguramiento teniendo en
cuenta las diferentes sentencias de la Corte Constitucional, ya que se ha observado que estas dos
figuras jurídicas han entrado en conflicto en cuanto a la aplicación dentro de los procesos penales
en Colombia.
Ahora bien, la presunción de inocencia tiene carácter de derecho fundamental y se encuentra
consagrado en el artículo 29 de la Constitución política de 1991 estipula que toda persona es
inocente hasta que no se le demuestre lo contrario, por otra parte, la medida de aseguramiento se
encuentra estipulada en la ley 906 de 2004 Código de procedimiento penal artículo 307, siendo
esta una figura jurídica la cual debe solicitar la Fiscalía General de la Nación como titular de la
persecución penal que por mandato constitucional en el artículo 250 se encuentra esta función,
ante el juez de Control de Garantías imponga esta medida restrictiva de la libertad a una persona
que se encuentra dentro del proceso penal sea considerado un peligro para la víctima, peligro para
la comunidad o pueda obstruir la justicia si continúa en libertad.
Finalmente, analizamos los diferentes pronunciamientos de la Corte Constitucional en torno a
estas dos figuras jurídicas, teniendo en cuenta que en la Constitución política se encuentra
consagrada como guardiana de las mismas, por ende, los pronunciamientos de la Corte tienen una
trascendencia fundamental en el contexto abordado.
This document has a specific purpose and is to carry out a bibliographic study about the prevalence between the presumption of innocence and the measure of assurance, taking into account the different rulings of the Constitutional Court, since it has been observed that these two legal figures have entered in conflict regarding the application in criminal proceedings in Colombia. Now, the presumption of innocence has the character of a fundamental right which is enshrined in article 29 of the 1991 Constitution, which establishes that everyone is innocent until proven otherwise. The assurance measure is stipulated in Law 906 of 2004 Code of Criminal Procedure Article 307, this being a legal figure that must be requested by the Attorney General's Office, which by constitutional mandate in Article 250 is this function, before the Guarantee Control judge so that it matters when the person who is in the criminal process is considered a danger to the victim, danger to the community or may obstruct justice if he continues to be free. Finally, the different pronouncements of the Constitutional Court regarding these two legal figures will be analyzed, it is important to remember that the political Constitution is consecrated as the guardian of the same, therefore the pronouncements of the Court have a fundamental transcendence in the context to be addressed.
