Resumen
El presente trabajo investigativo tiene como objetivo aplicar el test integrado de igualdad en medidas cautelares entre la especialidad laboral y civil, teniendo como línea metodológica la utilización de un paradigma dialógico, desde un enfoque cualitativo y un método hermenéutico, que permiten recopilar el discurso jurídico de diferentes normas y jurisprudencias en matrices de análisis documentales, información que mediante la técnica de análisis del discurso permite reinterpretar el derecho al acceso de la administración de justicia en igualdad procesal entre los justiciables, dando como resultado que el artículo 85A del Código Procesal del Trabajo no cumple con el propósito de proteger los derechos mínimos e irrenunciables, lo cual permite concluir que esta norma vulnera el principio de acceso a la justicia en igualdad procesal, sin embargo, al aplicar por analogía las cautelas innominadas del proceso civil en lo laboral se previene cualquier daño al garantizar el fallo judicial, este tipo de cautela entonces se perfecciona como una prerrogativa que puede aplicarse ante cualquier pretensión declarativa
The objective of this research work is to apply the integrated test of equality in precautionary measures between the labor and civil specialties, having as a methodological line the use of a dialogic paradigm, from a qualitative approach and a hermeneutic method, which allows compiling the legal discourse of different norms and jurisprudences in matrices of documentary analysis, information that through the technique of discourse analysis allows reinterpreting the right to access to the administration of justice in procedural equality between the justiciable, The result is that article 85A of the Labor Procedural Code does not comply with the purpose of protecting the minimum and unrenounceable rights, which allows concluding that this norm violates the principle of access to justice in procedural equality, however, by applying by analogy the unnamed precautionary measures of the civil process in labor matters, any damage is prevented by guaranteeing the judicial decision, this type of precautionary measure is then perfected as a prerogative that can be applied to any declarative claim
