Inconstitucionalidad frente al principio de transparencia en la contratación estatal con la aplicación del Decreto Legislativo No 440 de 2020

Resumen
El presente artículo tiene como objetivo hacer un acercamiento al fenómeno de afectación del principio de transparencia en la contratación estatal, a partir de las medidas establecidas por el Gobierno Nacional a través del Decreto legislativo No 440 de fecha 20 de marzo de 2020, mediante el cual se adoptan medidas de urgencia en materia de contratación estatal durante la problemática de la pandemia, que entre otros aspectos, eliminó las limitaciones a la adición de los contratos celebrados por la administración pública que se relacionen con bienes, obras y servicios que buscaran afrontar la emergencia sanitaria generada por el COVID-19.
El enfoque de la investigación fue cualitativo, dando aplicación al método hermenéutico que se encamina a descubrir, hallar contradicciones, deficiencias, omisiones entre las normas o el sistema jurídico. El objetivo general de la investigación estuvo enfocado determinar la afectación del principio de transparencia en la contratación estatal, conforme a las medidas tomadas por el Gobierno Nacional a través del Decreto Legislativo No 440 de 2020, que eliminó las limitaciones a la adición de los contratos celebrados por la administración pública.
Finalmente, se pudo concluir que mediante este tipo de mecanismos legales y ante la inesperada situación de la pandemia, los resultados fueron enmarcados hacia la proliferación de conductas como la corrupción, entre otros. Conforme al principio de transparencias, existe una trasgresión debido a la flexibilidad del contratante frente a las adiciones en los contratos celebrados con la administración pública.
The objective of this article is to make an approach to the phenomenon of affectation of the principle of transparency in state contracting, based on the measures established by the National Government through Legislative Decree No. 440 dated March 20, 2020, through which Urgent measures are adopted in terms of state contracting during the pandemic problem, which, among other aspects, eliminated the limitations on the addition of contracts entered into by the public administration that are related to goods, works and services that seek to deal with the emergency health generated by COVID-19. The research approach was qualitative, applying the hermeneutic method that is aimed at discovering, finding contradictions, deficiencies, omissions between the norms or the legal system. The general objective of the investigation was focused on determining the impact of the principle of transparency in state contracting, in accordance with the measures taken by the National Government through Legislative Decree No. 440 of 2020, which eliminated the limitations on the addition of contracts entered into. by the public administration. Finally, it was possible to conclude that through this type of legal mechanisms and given the unexpected situation of the pandemic, the results were framed towards the proliferation of behaviors such as corruption, among others. In accordance with the principle of transparency, there is a transgression due to the flexibility of the contracting party regarding the additions in the contracts entered into with the public administration
