Resumen
La estabilidad laboral funciona como una configuración La protección de los derechos de los trabajadores, la cual el fin primordial es garantizar el derecho a la pensión a todas esas personas que se encuentran próximas a adquirirla y estén vulnerables a un despido sin justa causa dentro de los tres años restantes para acceder a su pensión. La idea principal de este es ahorrar el despido en los años previos para alcanzar la pensión de vejez y no vulnerar así los derechos inherentes y tutela dos de este grupo de personas que se encuentran en estado endeble. La estabilidad laboral reforzada, se encuentra tipificada y protegida, para las personas del sector público y privado, siendo así un derecho incluyente, y tratando de minimizar la vulneración de derechos para las personas que ya cotizaron todas sus semanas y están a punto de adquirir su pensión. No se distinguirá si se trata de empleados de libre nombramiento o trabajadores de carrea, siendo así este un amparo constitucional tutelado, advocando así el mínimo vital, la dignidad humana, la seguridad social en pensión, los cuales al no respetarse este derecho se encontrarían lesionando de forma directa. Si se llegase a vulnerar la seguridad social en pensión, se debe reintegrar al empleado al cargo que ejercía o a uno igual o de superior jerarquía, hasta que se le escudriñe su renta vitalicia y sea incluido en nómina de pensiónanos.
