Resumen
El presente artículo crítico consiste en el estudio de la motivación de los actos
administrativos discrecionales, frente a la vulneración de principios y derechos
constitucionales de las personas que declaran insubsistente.
La constitución política de Colombia prevé los empleos públicos de libre
nombramiento y remoción, cuya situación es completamente distinta a los de
carrera, para estos la vinculación, permanencia y retiro de sus cargos depende de
la voluntad discrecional del nominador del gasto, quien goza de cierta
discrecionalidad para decidir libremente sobre estos, pero esta discrecionalidad no
es absoluta y tiene sus limitantes en la constitución política y jurisprudencias.
La Corte explicó que la discrecionalidad no puede ser interpretada ni confundirse
con la arbitrariedad.
Podrá entenderse como motivada cuando las calidades del empleado que se
nombró permiten ver, sin mayor dificultad, que el servicio que se está prestando
podría encontrarse mejor garantizado y ser más eficaz bajo la dirección de una
persona mejor calificada; es decir, que el reemplazo de un empleado por otro no
tendrá otra finalidad que el mejoramiento de las condiciones de la función pública.
This critical article is the study of the motivation of discretionary administrative acts, against the violation of constitutional principles and rights of people who declare unsubstantiated. The political constitution of Colombia provides for public employment of free appointment and removal, whose situation is completely different from those of career, for these the linking, permanence and withdrawal of their positions depends on the discretionary will of the nominator of the expense, who enjoys certain discretion to freely decide on these, but this discretion is not absolute and has its limitations in the political constitution and jurisprudence. The Court explained that discretion cannot be interpreted or confused with arbitrariness. It can be understood as motivated when the qualities of the employee that was appointed allow us to see, without major difficulty, that the service being provided could be better guaranteed and be more effective under the direction of a better qualified person; that is to say, that the replacement of an employee by another one will not have another purpose that the improvement of the conditions of the public function.
