Resumen
El presente documento abordó los elementos subjetivos y objetivos que debe tener el juez para no vulnerar el derecho constitucionalmente protegido para las partes a tener un juez imparcial; Cuando se encuentre el juez como director de un proceso judicial. Para lograr esto, este trabajo tuvo como propósito analizar las consecuencias procesales que inciden en la parcialidad del tercero supraordenado dentro del proceso, así como entender el tratamiento normativo del debido proceso en relación a la imparcialidad del Estado de jurisdicción por lo que se analizó esta temática desde el punto de vista normativo, doctrinal y jurisprudencial del debido proceso en relación a la imparcialidad del tercero supraordenado, conjuntamente con las consecuencias de la parcialidad del juzgador y estructurar los mecanismos de oposición contra la parcialidad del director del proceso, para alcanzar estos fines se trazó un diseño metodológico sustentado con un enfoque analítico y cualitativo documental, en cuanto a los resultados se identificaron como elementos de carácter subjetivos, objetivos y los mecanismos para resistir la parcialidad del director del proceso en Colombia para evitar las consecuencias de la acción lesiva que puede tener la parte al ser juzgado por un juez imparcial.
