Resumen
El trabajo que se pone a disposición de la respetada comunidad académica se trata
de un ensayo investigativo el cual tuvo por objetivo principal examinar los aspectos
que han contribuido a la constitucionalización del derecho administrativo desde el
análisis al derecho fundamental de petición a la luz de la jurisprudencia de la Corte
Constitucional. Este tema comporta una discusión que no se encuentra zanjada en
el derecho administrativo contemporáneo, siendo objeto de múltiples
pronunciamientos doctrinales alrededor de la discusión. De acuerdo con lo anterior,
el presente trabajo de investigación posee como propósitos específicos analizar los
antecedentes del derecho fundamental de petición en el derecho comparado
latinoamericano, evaluar el impacto de la constitucionalización del derecho de
petición como instrumento de participación ciudadana frente a la administración y
Estudiar la evolución del derecho fundamental de petición en la jurisprudencia de la
Corte Constitucional Colombiana. Conforme a ello, se presentan resultados de la
investigación que evidencian la importancia del derecho de petición en los sistemas
constitucionales comparados en los países de Latinoamérica y además, se resalta
un déficit informativo en ciudadanos y funcionarios que se traduce en barreras de
acceso al derecho y vulneraciones al mismo. También, se destaca la relevancia de
los pronunciamientos jurisprudenciales que propenden por el equilibrio de una
relación históricamente desigual entres Estado como Administración y ciudadano
como Administrado. En cuanto a la metodología, se aplica a través del enfoque
cualitativo, el método hermenéutico de investigación y se trata de una investigación
socio-jurídica donde se estudia una temática de relevancia social con influencia
normativa y jurídica directa. Algunos de los autores citados en el trabajo son Peralta
(2024), Duque y Martínez (2016) y la Corte Constitucional en diversos
pronunciamientos jurisprudenciales.
The work that is made available to the respected academic community is a research essay whose main objective was to examine the aspects that have contributed to the constitutionalization of administrative law from the analysis of the fundamental right to petition in the light of the jurisprudence of the Constitutional Court. This issue involves a discussion that is not settled in contemporary administrative law, being the subject of multiple doctrinal pronouncements around the discussion. Accordingly, the specific purposes of this research work are to analyze the background of the fundamental right to petition in Latin American comparative law, to evaluate the impact of the constitutionalization of the right to petition as an instrument of citizen participation before the administration, and to study the evolution of the fundamental right to petition in the jurisprudence of the Colombian Constitutional Court. Accordingly, research results are presented that show the importance of the right of petition in the constitutional systems compared in Latin American countries and also highlight an information deficit in citizens and officials that results in barriers to access to the right and violations to it. It also highlights the relevance of the jurisprudential pronouncements that tend to balance a historically unequal relationship between the State as Administration and the citizen as Administered. As for the methodology, it is applied through the qualitative approach, the hermeneutic method of research and it is a socio-legal research where a topic of social relevance with direct normative and legal influence is studied. Some of the authors cited in the work are Peralta (2024), Duque and Martínez (2016) and the Constitutional Court in various jurisprudential pronouncements.
