Trabajo en casa como consecuencia de la pandemia: respuesta a la necesidad de la continuidad laboral

Resumen
El sistema productivo es uno de los factores que más ha sufrido modificaciones tras enfrentar una problemática global como el virus covid-19, puesto que se implementó el trabajo en casa como una nueva modalidad de trabajo, enfocada en mantener el empleo y el dinamismo de las actividades laborales entendiéndolo como una respuesta a las decisiones tomadas por el Gobierno Nacional para mitigar y prevenir la rápida propagación de los contagios. De lo anterior, en el transcurso de la pandemia el trabajo en casa se convirtió en una de las consecuencias con mayor importancia para proporcionar una rápida solución a las problemáticas socioeconómicas que se estaban generando a raíz del aislamiento obligatorio que determinaba una inactividad laboral y el desempleo.
De esta manera, el trabajo en casa se trasfigura como una respuesta que permite desarrollar las funciones encargadas a los diferentes cargos, siendo esto un beneficio tanto para los empleadores como para los trabajadores; no obstante, el Estado Colombiano se vio obligado no solo a determinar ésta como la única modalidad permitida para ejercer el trabajo, sino también el deber de crear un marco reglamentario principalmente a través de lineamientos emitidos por la organización internacional de trabajo, el ministerio de trabajo y otros; para que sea inspeccionada, vigilada y controlada en el desarrollo de las actividades laborales cuya finalidad es atender y evitar abusos por y entre las partes, toda vez que esta modalidad de trabajo en casa llega a permitir una invasión o no reconocimiento entre en el tiempo de trabajo y el tiempo fuera de trabajo, por lo cual, se busca que exista armonía entre la prestación laboral del servicio de igual manera que en las modalidades habitualmente ejercidas y normativados en el código sustantivo del trabajo.
The productive system is one of the factors that has undergone the most modifications after facing a global problem such as the covid-19 virus, since work at home was implemented as a new work modality, focused on maintaining employment and the dynamism of labor activities, understanding it as a response to the decisions taken by the National Government to mitigate and prevent the rapid spread of contagions. From the above, in the course of the pandemic, work at home became one of the most important consequences to provide a rapid solution to the socioeconomic problems that were being generated as a result of the compulsory isolation that determined labor inactivity and unemployment. In this way, working at home became a response that allowed the development of the functions entrusted to the different positions, being this a benefit for both employers and workers; however, the Colombian State was forced not only to determine this as the only modality allowed to work, but also the duty to create a regulatory framework mainly through guidelines issued by the international labor organization, the ministry of labor and others; to be inspected, monitored and controlled in the development of labor activities whose purpose is to attend and avoid abuses by and between the parties, since this modality of work at home comes to allow an invasion or non-recognition between working time and time outside of work, for which, it is sought that there is harmony between the labor provision of the service in the same way as in the modalities usually exercised and regulated in the substantive labor code.
