Resumen
Este trabajo analiza la indemnización, la justicia y la reparación como pilares
fundamentales para lograr la paz y la dignificación de las víctimas del conflicto armado en
Colombia. Mediante el estudio de marcos jurídicos nacionales e internacionales, y de
mecanismos como la Ley 1448 de 2011 y el Sistema Integral de Verdad, Justicia,
Reparación y No Repetición, se evidencia cómo las víctimas han sido históricamente
excluidas y vulneradas. Se examinan los impactos del conflicto en la vida individual y
colectiva, así como la necesidad de reconocer testimonios y memorias como herramientas
de dignificación. El texto destaca los retos institucionales, presupuestales y sociales que
enfrenta el Estado colombiano en la implementación efectiva de una reparación integral.
Finalmente, se presentan propuestas para fortalecer la participación de las víctimas,
articular mejor las políticas públicas y consolidar una paz duradera basada en la justicia
restaurativa, la memoria histórica y el respeto por los derechos humanos.
This paper analyzes compensation, justice, and reparation as fundamental pillars for achieving peace and restoring the dignity of the victims of the armed conflict in Colombia. Through the study of national and international legal frameworks, and mechanisms such as Law 1448 of 2011 and the Comprehensive System of Truth, Justice, Reparation, and NonRepetition, it becomes evident how victims have been historically excluded and violated. The research examines the impact of the conflict on individual and collective lives and highlights the importance of recognizing testimonies and memory as tools for dignity. The paper also addresses the institutional, budgetary, and social challenges faced by the Colombian State in implementing effective comprehensive reparation. Finally, it presents proposals to strengthen victims’ participation, better articulate public policies, and consolidate lasting peace based on restorative justice, historical memory, and respect for human rights
