Resumen
El Derecho Animal se sitúa como el conjunto de teorías, principios y normas dispuestos a ofrecer
protección jurídica al animal, el cual es una especie distinta al ser humano, la normatividad se
encarga de promover y procurar su bienestar y protección al ser consideradas las mascotas como
parte de la familia. La protección de animales domésticos en situación de abandono y maltrato
refleja la falta de órganos de control que vigilen las entidades a cargo de la protección animal
porque no se puede ejercer adecuadamente el desarrollo normativo por el desinterés de la
administración pública y la falta de presupuesto para desarrollar políticas de protección y
prevención contra el maltrato y abandono de los animales junto con la reglamentación que permita
incluirlos como sujetos de especial protección constitucional desde la esfera política y
gubernamental. El objetivo general fue identificar la normatividad colombiana existente en temas
de protección jurídica a los animales domésticos y silvestres, desarrollándose en función de un
paradigma estructuralista y un tipo de investigación analítica de acuerdo a su diseño analítico
secuencial. Como resultado se logró enmarcar dos momentos que evidencian el disminuido auge
que ha tenido la protección constitucional de los animales domésticos y silvestres al no ser
reconocidos como sujetos sino como objetos. Es posible concluir que el Estado no ampara los
animales porque éstos se encuentran dentro y fuera de las comunidades físicas de los seres
humanos y debe incluirlos en las comunidades morales y políticas, con el fin de que sean titulares
de derechos.
Animal Law is situated as the set of theories, principles and norms willing to offer legal protection to the animal, which is a different species from the human being, the regulations are in charge of promoting and ensuring their welfare and protection when pets are considered as part of the family. The protection of domestic animals in a situation of abandonment and abuse reflects the lack of control bodies that monitor the entities in charge of animal protection because the regulatory development cannot be adequately exercised due to the lack of interest of the public administration and the lack of budget for develop protection and prevention policies against the mistreatment and abandonment of animals together with the regulations that allow them to be included as subjects of special constitutional protection from the political and governmental spheres. The general objective was to identify the existing Colombian regulations on legal protection issues for domestic and wild animals, developing based on a structuralist paradigm and a type of analytical research according to its sequential analytical design. As a result, it was possible to frame two moments that show the diminished boom that the constitutional protection of domestic and wild animals has had, as they are not recognized as subjects but as objects. It is possible to conclude that the State does not protect animals because they are found inside and outside the physical communities of human beings and must include them in moral and political communities, in order for them to be holders of rights.
