| dc.description.abstract | Dentro de la estructura jerárquica del Estado colombiano y su ordenamiento jurídico encontramos como máxima fuente del derecho la constitución política, promulgada con la asamblea nacional constituyente de 1991. En ella se enmarca un nuevo estado social de derecho de avanzada con principios y garantías fundamentalistas a los derechos humanos. Esta carta magna de avanzada instituye todo el funcionamiento, organización y estructura del estado colombiano; El objetivo de este artículo es interpretar cuales son los pronunciamientos de la Corte Constitucional. Este artículo se justifica porque la descentralización es el poder que ejercía dicho organismo central y como su nombre lo indica, es la separación y división de una autoridad, es aquel procedimiento donde se disipan poderes o cosas que fuera de un establecimiento o soberanía central. La metodología utilizada en el presente artículo es el Paradigma Histórico Hermenéutico Enfoque: Cualitativo. Método de investigación: Inductivo. Tipo de investigación: Descriptivo. Población y Muestra. Es el análisis de texto de las sentencias de la Corte, las Fuentes de obtención de la información: Secundarias. La principal conclusión es que aaunque persisten varios problemas y deficiencias en la estrategia de descentralización, el diseño del presente trabajo ha sido integral en la medida en que ha contemplado acciones en los distintos componentes, con la finalidad de crear un escenario favorable para la gestión local. | spa |
| dc.description.abstract | Within the hierarchical structure of the Colombian State and its legal system, we find the political constitution as the highest source of law, promulgated with the National Constituent Assembly of 1991. It frames a new advanced social state of law with fundamentalist principles and guarantees to the human rights. This state-of-the-art Magna Carta establishes the entire operation, organization, and structure of the Colombian state; the objective of this article is to interpret which are the pronouncements of the Constitutional Court. This article is justified because decentralization is the power exercised by said central body and as its name indicates, it is the separation and division of an authority, it is that procedure where powers or things that are outside of a central establishment or sovereignty are dissipated. The methodology used in this article is the Historical Hermeneutic Paradigm Approach: Qualitative. Research method: Inductive. Type of research: Descriptive. Population and Sample. It is the text analysis of the judgments of the Court, the Sources of obtaining the information: Secondary. The main conclusion is that although several problems and deficiencies persist in the decentralization strategy, the design of this work has been comprehensive to the extent that it has contemplated actions in the different components, in order to create a favorable scenario for local management. | eng |
