Actos procesales de notificación personal, presentación del poder en el CGP y prestación del servicio de justicia al amparo del decreto 806 de 2020

Resumen
Complementando la normativa promulgada por el Código General del Proceso y actuando como un instrumento funcional capaz de modificar de manera temporal las practicas relacionadas con el ejercicio de los actos judiciales en pro de agilizar los procesos y en consecuencia flexibilizar la oportuna atención a los usuarios de los servicios ofrecidos por la justicia colombiana, el Decreto 806 de 2020 apareció en el escenario jurídico como una medida de contingencia y en concordancia a su naturaleza puso en evidencia la forma como pueden aprovecharse las tecnologías de la comunicación y la información para lograr una mayor efectividad y en pro de lograr una acceso equitativo de aquellas personas que requieren los servicios judiciales a través de la digitalización. El ensayo científico construido alrededor de estas premisas realiza una comparación de la modificación efectuada a los actos procesales de notificación personal y presentación personal del poder en la legislación procesal vigente en Colombia, esto es, Código General del Proceso, analizándose en consecuencia la forma como cambia la modalidad de prestación del servicio de justicia, en virtud de la declaratoria de Emergencia Sanitaria declarada por el Estado Colombiano en virtud de la pandemia Covid- 19 y la suspensión de términos decretada a partir del 15 de marzo de 2020.
Complementing the regulations promulgated by the General Code of Process and acting as a functional instrument capable of temporarily modifying the practices related to the exercise of judicial acts in favor of speeding up the processes and consequently making more flexible the timely attention to the users of the services offered by Colombian justice, Decree 806 of 2020 appeared on the legal scene as a contingency measure and, in accordance with its nature, highlighted the way in which communication and information technologies can be used to achieve greater effectiveness and in favor of achieving equitable access for those who require judicial services through digitization. The scientific essay built around these premises makes a comparison of the modification made to the procedural acts of personal notification and personal presentation of power in the procedural legislation in force in Colombia, that is, the General Code of the Process, consequently analyzing the way in which it changes. the modality of providing the justice service, by virtue of the declaration of a Sanitary Emergency declared by the Colombian State by virtue of the Covid-19 pandemic and the suspension of terms decreed as of March 15, 2020.
