Eximentes de responsabilidad administrativa como mecanismos protectores del estado, una mirada desde las altas cortes

Resumen
Debido a la libertad de configuración legislativa y de las distintas escuelas doctrinales con las que puedan estar identificados los distintos operadores judiciales, existen diferencias en las formas como se adoptan ciertos conceptos jurídicos y la forma de aplicación de los mismos en casos concretos, es así que pudieron ocurrir disidencias conceptuales en cada una de las altas cortes con relación a los eximentes de responsabilidad y sus elementos estructurales que hayan afectado la toma de sus decisiones. Lo anterior conlleva a determinar si existe seguridad jurídica cuando se toma una decisión por parte de un juez contencioso y al ser revisado en sede de tutela por otro juez ordinario o en una eventual revisión por la Corte Constitucional, que confirme una claridad conceptual, que no desconozca los derechos de quien reclama una vulneración a causa de una actuación de la administración. Para ello se recurrió a revisar con metodología histórico hermenéutica, sentencias relevantes sobre la materia en cada una de las altas cortes y determinar la congruencia conceptual con lo que respecta a los eximentes de responsabilidad, determinando que para el objeto de estudio, se observa que existe en las decisiones tomadas por cada corte, el respeto por el ordenamiento constitucional y convencional, y que las decisiones se toman observando y respetando la jurisprudencia que cada una de estas cortes han emitido y además complementándose entre ellas.
Due to the freedom of legislative configuration and the different doctrinal schools with which the different judicial operators may be identified, there are differences in the ways in which certain legal concepts are adopted and the way in which they are applied in specific cases, so that conceptual dissidences may have occurred in each of the high courts in relation to the exonerations of liability and their structural elements that have affected their decision making. The above leads to know if there is legal certainty when a decision is made by a contentious judge and is subsequently reviewed in a tutela proceeding by another ordinary judge and in an eventual review by the Constitutional Court, which confirms a conceptual clarity that does not disregard the rights of those who claim a violation due to an action of the administration. For this purpose, we resorted to a historical review of relevant judgments on the matter in each of the high courts and to determine the conceptual congruence with respect to the exemptions of liability, determining that for the object of study, it is observed that in the decisions taken by each court there is respect for the constitutional and conventional order, and that the decisions are taken taking into account and respecting the jurisprudence that each of these courts have issued, in addition to complementing each other.
