Resumen
El Silencio administrativo positivo es una figura del derecho administrativo
que contempla que, en caso de que una entidad pública no responda una
petición dentro de un plazo determinado se asumirá que la entidad ha
otorgado la solicitud requerida.
Con la Constitución de 1991 en el cumplimiento de los fines sociales, el
Estado debe garantizar los servicios públicos domiciliarios en todo el
territorio nacional y adicional velar por qué esta prestación del servicio sea
eficaz, por lo anterior, la superintendencia de servicios públicos domiciliarios
se encargará de la vigilancia control e inspección de las empresas
prestadoras de servicios públicos domiciliarios, garantizando estos fines
sociales con el cumplimiento de la ley.
En Colombia, el silencio administrativo positivo en servicios públicos
domiciliarios está regulado por la ley 142 de 1994 que contempla, que las
empresas administradoras de servicios públicos domiciliarios están
obligadas a dar respuesta de fondo a los solicitudes, peticiones o recursos en
un término perentorio que no puede ser mayor a 15 días hábiles, y si llegado
el caso estas empresas no dan respuesta en el plazo señalado en la norma, se
entenderá que la solicitud o petición ha sido aceptada y la empresa debe
proceder a prestar el servicio.
