Resumen
Este estudio de caso tiene como objetivo general el análisis de los tipos de violencia
sexual y en concurso con otros delitos cometidos por Hernán Giraldo Serna en el
marco del conflicto armado colombiano, esto se logrará a partir de la descripción
del nexo causal existente entre los delitos sexuales causados por Hernán Giraldo y
el conflicto armado surtido en la región de la Sierra Nevada de Santa Marta, y la
identificación de las estrategias utilizadas por el precitado sujeto activo de los delitos
en mención, en el ejercicio del control social y expansión de la red criminal familiar
en la región. El diseño utilizado es cualitativo, por medio de un estudio de caso, el
cual se fue estructurando a partir de la revisión documental, de textos, y diferentes
informes realizados por organizaciones defensoras de los derechos de las Mujeres,
como la Corporación Humanas, Sisma Mujer y las investigaciones realizadas por el
Centro Nacional de Memoria Histórica.
The general objective of this case study is the analysis of the types of sexual violence and in competition with other crimes committed by Hernán Giraldo Serna in the framework of the Colombian armed conflict, this will be achieved from the description of the existing causal link between the sexual crimes caused by Hernán Giraldo and the armed conflict in the region of the Sierra Nevada de Santa Marta, and the identification of the strategies used by Hernán Giraldo Serna in the exercise of social control and expansion of the family criminal network in the region. The design used is qualitative, by means of a case study, which was structured from the review of documents, texts, and different reports carried out by organizations defending women's rights, such as Corporación Humanas, Sisma Mujer and the research carried out by the National Center of Historical Memory. The results show how sexual violence is established as a war strategy in the armed conflict.
