Interpretación jurisprudencial del uso de contratos de prestación de servicios por entidades estatales

Resumen
Con este ensayo se pretende demostrar la arbitrariedad de la administración
pública en relación a los contratos de prestación de servicios, donde se vulnera
derechos fundamentales, abarcando así, las posturas más relevantes desde una
óptica jurisprudencial.
De esta perspectiva, se analiza características especiales y distintas entre un
contrato de prestación de servicios y un contrato de trabajo, como aquella fuente de
obligaciones, que tanto el contratista y la contratante, llamada entidad del estado, se
comprometen para el cumplimiento de lo establecido en estos.
El primero permite más libertad entre el contratante y el contratista; los
honorarios, las jornadas de trabajo, la forma en que se va a desempeñar el servicio y
la subordinación no existe a mayor escala.
Consideramos que los contratos de prestación de servicios son muy importantes y
han sido una herramienta muy utilizada para vinculaciones de personal, llevando así
actividades específicas, pero ha tema de muchos debates por la forma en que han
sido manejados, pero rescatamos que la administración pública ha sido generadora
de empleos en debida forma a pesar de la mala praxis en algunos contratos que no
se rigen por lo establecido en los contratos.
Al analizar esta problemática fue necesario mencionar las causas y las
consecuencias que trae esta contrariedad para ambas partes; primero un contrato
de prestación de servicios tiene que reunir los requisitos señalados en la Ley 80 de
1993, las que contiene el código de trabajo y el código civil, ya que estos
ordenamientos jurídicos existen diferentes tipos de contrataciones que no existen en
la ley 909 de 2004.
This essay aims to demonstrate the arbitrariness of public administration in relation to service provision contracts, where fundamental rights are violated, encompassing the most relevant positions from a jurisprudential perspective. From this perspective, special and distinct characteristics between a service provision contract and an employment contract are analyzed, as that source of obligations, which both the contractor and the contracting party, called the state entity, commit to comply with what is established in these. The former allows more freedom between the contracting party and the contractor; fees, working hours, the way the service is to be performed, and subordination do not exist on a larger scale. We consider that service provision contracts are very important and have been a widely used tool for personnel hiring, thus carrying out specific activities, but it has been a subject of much debate due to the way they have been managed, but we highlight that public administration has been a generator of jobs in due form despite the malpractice in some contracts that are not governed by what is established in the contracts. When analyzing this problem, it was necessary to mention the causes and consequences that this contradiction brings for both parties; first, a service provision contract must meet the requirements indicated in Law 80 of 1993, which contains the labor code and the civil code, since these legal systems have different types of contracts that do not exist in Law 909 of 2004.
