Resumen
El presente trabajo se propone como objetivo identificar el límite de la prohibición
de la participación en política de los funcionarios públicos en el Estado Social de
derecho Colombiano en lo referente a la asistencia a eventos políticos, lo anterior
en el entendido que se ha convertido en una constante en la operancia de los
organismos de control disciplinario, imponer sanciones éticas como consecuencia
de la asistencia de funcionarios públicos a eventos políticos en calidad de audiencia.
El ordenamiento jurídico colombiano ha resaltado que la función pública constituye
la máxima expresión del deber ser del comportamiento ciudadano, siendo las
personas que fungen como empleados públicos representantes del poder estatal,
es así que a los mismos se les exige una conducta idónea, siendo destinatarios de
diferentes tipos de responsabilidad ente el incumplimiento de este cometido. A tal
efecto la prohibición que impide que funcionarios públicos participen en política es
válida, puesto evita que la función pública se halle al servicio de intereses
particulares en el interior de procesos electorales y en deterioro de la voluntad del
elector, sin embargo esta prohibición no lleva implícito la limitación de los Derechos
políticos del funcionario.
La jurisprudencia nacional ha sido reiterativa en afirmar constantemente que la
defensa del espíritu democrático mediante la conservación de la imparcialidad de la
función pública, no debe de ser desplegada en deterioro de las garantías
individuales del ciudadano que labora para el Estado, siendo necesario que se
examinen los contenidos jurídicos que hacen parte de este debate.
The present work aims to identify the limit of the prohibition of the participation in politics of public officials in the social state of Colombian law in relation to attendance at political events, the foregoing in the understanding that it has become a constant in the operation of disciplinary control agencies, impose ethical sanctions Como consequence of the attendance of public officials to political events as a hearing, this in obvious deterioration and damage to the political rights of those affected, coupled with a lack of knowledge of Rights to equality, freedom of conscience and association. The Colombian legal system has been reiterative in highlighting that the public function constitutes the maximum expression of the duty to be of citizen behavior, being the people who work as public employees representing the state power, so that they are required to perform appropriate behavior, being recipients of different types of responsibility between the breach of this task. For this purpose, the prohibition that prevents public officials from participating in politics is valid, since it prevents the public function from serving private interests within electoral processes and deteriorating the will of the elector, however this prohibition does not lead implicitly the limitation of the political rights of the official, in this regard the jurisprudence has been repeated in constantly affirming that the defense of the democratic spirit by preserving the impartiality of the public function, should not be deployed in deterioration of the individual guarantees of the citizen who works for the State, being necessary to examine the legal contents that are part of this debate.
