Resumen
La pandemia surgida a partir del virus SARS COV-2, llamado COVID – 19, produjo una
serie de retos que debieron afrontar los diferentes Estados. Colombia no fue la excepción, toda vez
que tuvo que mudar sus procesos presenciales a los virtuales, especialmente, en materia judicial,
debido a que la justicia digital se convirtió en la forma de realizar estos procedimientos. En materia
disciplinaria, las entidades tuvieron que generar lineamientos para atender las solicitudes por esta
vía, sin que ellos significasen un perjuicio para los intervinientes. El objetivo general es analizar
la manera como el Estado colombiano afrontó la realización de procesos disciplinarios
virtualmente, a partir de la declaratoria de pandemia. El enfoque utilizado es el cualitativo. Se
concluyó que esta situación mostró la precariedad en la que se encontraba la justicia digital
colombiana, aunque se venían realizando esfuerzos para modernizar este tipo de procedimientos,
incluida la capacitación a los funcionarios públicos.
The pandemic that emerged from the SARS COV-2 virus, called COVID-19, produced a series of challenges that the different States had to face. Colombia was no exception, since it had to change its face-to-face processes to virtual ones, especially in judicial matters, because digital justice became the way to carry out these procedures. In disciplinary matters, the entities had to generate guidelines to deal with the requests by this means, without them meaning a detriment to the interveners. The general objective is to analyze the way in which the Colombian State faced the conduct of disciplinary processes virtually, from the declaration of a pandemic. The approach used is qualitative. It was concluded that this situation showed the precariousness of Colombian digital justice, although efforts had been made to modernize this type of procedure, including training public officials.
