Resumen
Con el paso de los años las condiciones laborales en la sociedad han tomado un rumbo diferente, se ha notado una incursión acelerada de las plataformas digitales de servicios y las formas contemporáneas de llevar a cabo el trabajo, llevando esto a una discusión entre la verdadera naturaleza del vínculo contractual entre los trabajadores y los empresarios, aumentando la problemática de la explotación laboral y la desigualdad salarial, cuestión que cada día se hace más visible debido a la falta de oportunidades laborales en el campo tradicional, arrojando a los ciudadanos a ser parte de esta nueva forma de oportunidad laboral, pero que tiene esta dicotomía entre el ser y el no tener lo fundamentos legalmente establecidos que favorezcan las condiciones básicas de los trabajadores. En la presente investigación se busca analizar de manera integral y profunda el impacto de la deslocalización industrial del trabajo en plataformas digitales en Colombia, centrándose en la explotación laboral y la desigualdad salarial, con el fin de comprender las implicaciones socioeconómicas, laborales y legales de este fenómeno, y proponer recomendaciones orientadas a mitigar sus efectos negativos en los trabajadores y promover condiciones laborales justas y equitativas. esto a través de una revisión bibliográfica, de la lectura e interiorización de la normatividad vigente sobre la temática propuesta, llevando esto a una reflexión de la temática y de la forma cómo se viene presentando en Colombia esta situación desde la llegada de la pandemia hasta ahora. Desde esta perspectiva, se puede reconocer que en Colombia se tiene un marco de protección laboral limitado, porque, aunque existen fundamentos legales y normativos aún no se logra establecer una ley o normativa que permita llenar los vacíos de hecho y de derecho porque estamos frente a una problemática moderna, emergente y muy desafiante.
Over the years, working conditions in society have taken a different direction; an accelerated incursion of digital service platforms and contemporary ways of carrying out work has been noted, leading to a discussion among true nature of the contractual link between workers and employers, increasing the problem of labor exploitation and wage inequality, an issue that becomes more visible every day due to the lack of job opportunities in the traditional field, throwing citizens into be part of this new form of job opportunity, but that has this dichotomy between being and not having the legally established foundations that favor the basic conditions of workers. This research seeks to analyze the impact of the industrial relocation of work comprehensively and deeply on digital platforms in Colombia, focusing on labor exploitation and wage inequality, in order to understand the socioeconomic, labor and legal implications. of this phenomenon, and propose recommendations aimed at mitigating its negative effects on workers and promoting fair and equitable working conditions. All this through a bibliographic review, reading and internalization of the current regulations on the proposed topic, leading to a reflection on the topic and the way in which this situation has been presented in Colombia since the arrival of the pandemic so far. From this perspective, it can be recognized that Colombia has a limited labor protection framework, because, although there are legal and regulatory foundations, it has not yet been possible to establish a law or regulation that allows filling the legal and factual gaps because we are facing a modern, emerging, and very challenging problem.
