Resumen
En el presente se realiza una reflexión sobre las características y los cambios
actuales en el Estado Social de Derecho y su proyección en la Administración
pública que responda al modelo de Estado. En este sentido el Estado Social de
Derecho se ubica en una posición más garantista en relación a los derechos de la
persona humana, lo que define una identidad propia de la Administración pública de
este modelo de Estado.
Lo anterior resulta de gran valía en un contexto como el nuestro, en el que a pesar
de la consagración positiva de amplio plexo de derechos fundamentales en la propia
Constitución, y de la incorporación al ordenamiento jurídico interno de los derechos
humanos contenidos en instrumentos internacionales por vía del bloque de
constitucionalidad (C. P., Art. 93), estos derechos no son garantizados en debida
forma, e incluso son vulnerados por las propias autoridades públicas, lo que lleva a
pensar que el Estado colombiano ha incumplido las obligaciones que la misma
Constitución le endilga.
In the present, a reflection is made on the current characteristics and changes in the Social Rule of Law and its projection in the public Administration that responds to the State model. In this sense, the Social Rule of Law is located in a more guaranteed position in relation to the rights of the human person, which defines an identity of the public Administration of this model of State. The foregoing is of great value in a context such as ours, in which despite the positive consecration of a broad plexus of fundamental rights in the Constitution itself, and the incorporation into the internal legal order of human rights contained in international instruments by Through the constitutional block (CP, Art. 93), these rights are not duly guaranteed, and are even violated by the public authorities themselves, which leads us to believe that the Colombian State has breached the obligations that the Constitution itself fool.
