Resumen
Muchos estudios anteriores (Peralta Huiracocha, 2021), Sabadell-Bosch (2020)
Barreneche (2021), Arango y Preciado (2021) coinciden con que el teletrabajo,
trabajo en casa y trabajo remoto son modalidades laborales que crecerán en los
próximos años trayendo ventajas y desventajas tanto a empresarios como a
empleados. Elaborar una revisión leyes que regulan el Teletrabajo, El trabajo en
Casa y el Trabajo Remoto.
Es una Investigación cualitativa, donde se realizó una revisión de la legislación
sobre teletrabajo, trabajo en casa y trabajo remoto.
La implementación de estas normas ha creado las condiciones propicias para
que las empresas en Colombia y para que el sector público ejecuten los contratos
laborales, prestación de servicios o sus labores propias de sus cargos en estas
modalidades lo que permitió que durante la Pandemia se mantuvieran los puestos
de trabajo para muchos colombianos y aumentara exponencialmente la ejecución
de estas modalidades, las cuales por la contención de los contagios de Covid 19
logro buenos resultados durante esa etapa, el reto está en que se pueda seguir
aumentando la cantidad de empresas y trabajadores que opten por estas
modalidades en condiciones dignas, lo que se debe tener en cuenta es la
formalización y divulgación de las políticas relacionadas, además de generar
incentivos para que se pueda lograr una aplicación de manera paulatina de esta
modalidad, cambiando la mentalidad de los empleadores, así como de los
empleados.

The implementation of these norms has created the right conditions for companies in Colombia and for the public sector to execute labor contracts, provision of services or their own work in these modalities, which allowed many Colombians to keep their jobs during the Pandemic and exponentially increase the execution of these modalities, which due to the containment of Covid 19 infections achieved good results during that stage, The challenge is to continue increasing the number of companies and workers who opt for these modalities in decent conditions, what must be taken into account is the formalization and dissemination of related policies, in addition to generating incentives to achieve a gradual implementation of this modality, changing the mentality of employers and employees. Telework, work at home and remote work have had a worldwide growth in recent years in the world, this accelerated due to the pandemic caused by SARS COV-2, better known as Covid 19, in Colombia, the Ministry of ICT (2020) establishes that the implementation of telework in the country in 2020 was 18% of the national companies, but when compared with the one presented by the Ministry of Labor (2021), that percentage rose to 71.1%, which shows the boom that has had this labor modality in the country. It is imperative that in Colombia are given greater disclosure to the laws related to telework, remote work and work at home, since when reviewing the jurisprudence it is observed that there is mostly ignorance that lead to errors in the application of the law.
