Resumen
Este trabajo analiza el derecho de petición como mecanismo de control ciudadano frente a la gestión administrativa en Colombia, destacando su fundamento constitucional y los desafíos prácticos que enfrenta, como el silencio administrativo y la falta de respuesta oportuna. Su objetivo es examinar el marco normativo, identificar barreras estructurales y evaluar su efectividad. Se adopta un enfoque cualitativo y documental dentro del paradigma socio-crítico, utilizando análisis de leyes, jurisprudencia y literatura académica reciente. La investigación busca fortalecer el ejercicio del derecho de petición como herramienta clave de participación democrática y vigilancia ciudadana sobre lo público. Los resultados evidencian que, si bien el derecho de petición está consagrado en el artículo 23 de la Constitución y regulado por la Ley 1755 de 2015, su aplicación enfrenta serias limitaciones operativas y desconocimiento ciudadano. Casos emblemáticos revelan tanto fallos favorables de la Corte Constitucional que fortalecen el control social, como situaciones en las que la inadecuada formulación o falta de respuesta adecuada debilita su alcance. Como conclusión, se establece que el derecho de petición, pese a su robusto marco legal, aún requiere una mayor apropiación ciudadana y voluntad institucional.
Es esencial avanzar en formación cívica, implementación de prácticas que lo hagan accesible y sanciones efectivas ante el incumplimiento, a fin de consolidarlo como un instrumento eficaz de transparencia y rendición de cuentas en la administración pública.
This study analyzes the right to petition as a mechanism of citizen oversight of administrative management in Colombia, highlighting its constitutional foundation and the practical challenges it faces, such as administrative silence and the lack of timely responses. Its objective is to examine the regulatory framework, identify structural barriers, and assess its effectiveness. A qualitative and documentary approach is adopted within the socio critical paradigm, using the analysis of laws, jurisprudence, and recent academic literature. The research aims to strengthen the exercise of the right to petition as a key tool for democratic participation and citizen oversight of public affairs. The findings show that, although the right to petition is enshrined in Article 23 of the Constitution and regulated by Law 1755 of 2015, its application faces serious operational limitations and a lack of citizen awareness. Landmark cases reveal both favorable rulings by the Constitutional Court that enhance social control and situations in which poor formulation or inadequate responses weaken its scope. In conclusion, it is established that the right to petition, despite its robust legal framework, still requires greater citizen ownership and institutional commitment. Advancing civic education, implementing accessible practices, and enforcing effective sanctions for noncompliance are essential steps to consolidate it as an effective instrument for transparency and accountability in public administration
