Resumen
En el sistema jurídico colombiano, con la promulgación de la constitución política de 1991,
se otorgó un catálogo de Derechos en pro de la protección de la población en situación de
discapacidad, con el fin de que estas pudieran ejecutar un rol activo dentro de la sociedad,
aportando y desarrollando labores de forma adecuada, realizando cualquier tarea, sin que se
presentase discriminación alguna debido a la limitación física que presenten; garantizándoles de
esta forma desde la norma un acceso al mercado laboral en condiciones que dignifiquen su rol y
rehabiliten su aporte a la sociedad, sin embargo, muchas veces lo anterior no trasciende al plano
real de contratación de este grupo poblacional en el país.
De este modo, en la Constitución Política Colombiana de (1991) se pueden apreciar artículos
como el 47.
Con el que se pretende no solo brindar una protección en materia de salud y rehabilitación
para la patología padecida en este caso la discapacidad física, sino también garantizar una
adhesión social adecuada de todas las personas discapacitadas enmarcando un Derecho de
igualdad, que se podría facilitar con un acceso de esta población al mundo laboral, como lo
establece el artículo 54 de la Constitución Política Colombiana.
Con el fin de que puedan desempeñarse con autonomía en la sociedad.
Por las garantías constitucionales expresadas con anterioridad, en nuestro país se debe
observar un acceso mayor al ámbito laboral de las personas en situación de discapacidad, sin
embargo, cuando se observa en las estadísticas del DANE la tasa de personas con discapacidad
en Colombia para el censo del 2005 rondaba el 6,1%, cifra que equivale a 2.624.898 ciudadanos
colombianos, de los cuales al año 2017 se encuentran incluidas en el Registro para la localización y caracterización de personas con discapacidad – Registro para la localización y
caracterización de personas con discapacidad RLCPD 1.342.222, de la población incluida en el
Registro para la localización y caracterización de personas con discapacidad RLCPD solo el
162.498 (12,1%) de las personas en situación de discapacidad se encuentra desempeñando
alguna labor remunerada (Ministerio de Salud y Protección Social, 2017).
Uno de los factores importantes, y que es señalado por la Corte Constitucional, para que se
genere una mayor empleabilidad de la Población en Situación de Discapacidad debe ser la
rehabilitación laboral, por lo que las capacitaciones, como vinculo de una adecuación laboral
deben realizarse de acuerdo a las condiciones de salud de la persona.
Esta discriminación positiva debe ser, de acuerdo con el orden constitucional, adelantada por
parte del estado, el cual debe garantizar las medidas necesarias para que estas personas se puedan
desenvolver de manera adecuada en la sociedad, dado que, por lo anterior, se analizaran las
medidas adelantadas por el estado para incentivar la contratación de personas en situación de
discapacidad.
Por lo descrito, se pretende analizar la efectividad de los esfuerzos adelantados en la
actualidad por el Estado colombiano a través de su normativa vigente para que la contratación de
la población en situación de discapacidad incremente
