Resumen
El presente estudio de caso tiene por objetivo desde la figura del estado de cosas inconstitucionales hacer un valioso aporte en el contexto del sistema jurídico en el ámbito del derecho penitenciario, muy poco conocido por los abogados en ejercicio.
Los jueces de ejecucion de penas y medidas de seguridad desconocen el estado de cosas inconstitucionales y de igual manera desconocen la aplicación del principio de favorabilidad de la ley penal, el imperio de la ley y los subrogados penales contenidos en la ley 1709 de 2014, la cual fue diseñada por el legislador en busca de las desprisionalización y descongestión de la cárceles y penitenciarias del país, ley que ha causado un efecto totalmente contrario a su objetivo.
La aplicación de tales beneficios se ha visto impedida por la óptica que han venido adoptando los jueces de ejecucion de penas en la concesión de los mismos, tema que particularmente se cuestiona en el sentido del presente estudio que se fundamenta en la inaplicación del principio de favorabilidad de la ley penal, a sabiendas que el delito que se juzgó y ejecutorió data del año 2004, y al cual se le aplico un marco normativo totalmente contrario y desfavorable, en caso contrario se soporta este con la concesión del subrogado de libertad condicional concedido a otro condenado al cual su juez SI le concedió el subrogado deprecado.
The purpose of this case study has the goal from the unconstitutional situation to make a valuable contribution in the context of the legal system in the field of penitentiary law, very little known by practicing lawyers. The judges of execution of sentences and security measures ignore the unconstitutional situation and likewise are unaware of the application of the principle of favourability of criminal law, the rule of law and criminal substitutes contained in Law 1709 of 2014, which was designed by the legislator in search of the detachment and decongestion of the country's jails and penitentiaries, a law that has caused an effect totally contrary to its objective. The application of such benefits has been impeded by the perspective that the judges of execution of sentences have been adopting in granting them, an issue that is particularly questioned in the sense of this study, which is based on the non-application of the principle of favourability of the criminal law, knowing that the crime that was judged and executed dates from the year 2004, to which a totally contrary and unfavorable normative framework was applied, otherwise this is supported with the granting of the conditional freedom granted to another convicted person to whom the judge did grant the surrogate deprecated.
