Resumen
La presente investigación pretende indagar sobre la perspectiva de género a través de los acuerdos de custodia y cuidado personal de los niños, niñas y adolescentes de padres separados en la conciliación extrajudicial, haciendo que resalten los mecanismos alternativos de solución de conflictos dentro del entorno familiar al ser un proceso menos agresivo frente al judicial, que se ejecuta a través el diálogo y el ganar-ganar para la toma de decisiones, tanto, como en las diferentes problemáticas que puedan surgir como la falta de reconocimiento al trabajo no remunerado y corresponsabilidad parental, ya que, acarrea una sobrecarga y diferentes fricciones entre padre y madre. Se situó en la pandemia de Covid-19 año 2020 y 2021 que ha expuesto aún más las desigualdades de género, ya que las mujeres se ven obligadas a asumir más responsabilidades domésticas debido al cierre de escuelas y la necesidad de trabajar desde casa y así promover la participación de padres y madres en la corresponsabilidad del trabajo doméstico y de cuidado con sus hijos.
Su objetivo general es analizar desde la perspectiva de género los acuerdos de custodia y cuidado personal para los niños, niñas y adolescentes en el Centro de Conciliación adscrito al Consultorio Jurídico de la Universidad Simón Bolívar sede Barranquilla en la pandemia Covid-19 año 2020-2021.
La metodología utilizada es el cualitativa mediante análisis documental al recopilar y revisar las actas de conciliación en custodia, descriptivo, ya que se describe en el instrumento por el análisis textual discursivo de Moraes y Galliazi, se hizo la caracterización de las actas de conciliación lo encontrado en el cuerpo de los acuerdos de custodia revisando si había evidencia de coparentalidad, bajo un paradigma histórico- hermenéutico, examinándolo con perspectiva de género. Los instrumentos utilizados fueron: una matriz analítica de contenido ejecutada en hoja de Excel extrayendo los datos de las actas para revisar con mayor detalle las actas, posterior se realizaron unas fichas de análisis a modo de filtro donde contenían la información de las actas ajustadas a la investigación y, por último, una tabla de caracterización.
The present research aims to investigate the gender perspective through the custody and personal care agreements of children and adolescents of separated parents in extrajudicial conciliation, highlighting the alternative conflict resolution mechanisms within the family environment by be a less aggressive process compared to the judicial process, which is carried out through dialogue and win-win for decision-making, both, and in the different problems that may arise such as the lack of recognition of unpaid work and parental co-responsibility, since it brings an overload and different frictions between father and mother. It was set in the Covid-19 pandemic year 2020 and 2021 which has further exposed gender inequalities, as women are forced to take on more domestic responsibilities due to school closures and the need to work from home and thus promote the participation of fathers and mothers in the co-responsibility of domestic work and care with their children. Its general objective is to analyze from a gender perspective the custody and personal care agreements for boys, girls and adolescents in the Conciliation Center attached to the Legal Office of the Simón Bolívar University Barranquilla headquarters in the Covid-19 pandemic year 2020-2021 . The methodology used is qualitative through documentary analysis when compiling and reviewing the conciliation minutes in custody, descriptive, since it is described in the instrument by the discursive textual analysis of Moraes and Galliazi, the characterization of the conciliation minutes was made. in the body of the custody agreements, reviewing whether there was evidence of coparenting, under a historical-hermeneutical paradigm, examining it from a gender perspective. The instruments used were: a content analytical matrix executed in an Excel sheet extracting the data from the minutes to review the minutes in greater detail, later analysis sheets were created as a filter where they contained the information of the minutes adjusted to the investigation and, finally, a characterization table.
