Resumen
En la práctica judicial cotidiana, se ha podido evidenciar que es común que los profesionales
del derecho al momento de presentar demandas declarativas, soliciten medidas cautelares
ilógicas e improcedentes, con el fin de eximirse de agotar la conciliación como requisito de
procedibilidad para acceder a la jurisdicción civil, en este sentido, el presente articulo tiene
por objeto, analizar si existe un abuso de la solicitud de medidas cautelares por parte de los
abogados litigantes para evitar agotar la conciliación prejudicial en los procesos verbales,
para alcanzar este fin, se ha elaborado un diseño metodológico con paradigma hermenéutico,
con un enfoque cualitativo y con un nivel de investigación descriptivo, con este articulo
científico, se presente estudiar cómo debe proceder el juez frente a la admisión de la demanda
declarativa cuando se presenten solicitudes de medidas cautelares abiertamente
improcedentes y que soluciones jurídicas se pueden brindar para hacerle frente a
problemática.
