Resumen
El ensayo aborda la estabilidad laboral reforzada por salud en Colombia, un derecho que protege a los trabajadores vulnerables debido a problemas de salud. Este derecho, presente en la Constitución de 1991 y la Ley 361 de 1997, asegura que los trabajadores no sean despedidos sin justa causa. Sin embargo, uno de los mayores desafíos para su aplicación es el desconocimiento de estos derechos tanto por parte de los trabajadores como de los empleadores. El trabajo analiza la jurisprudencia de la Corte Constitucional y la Corte Suprema de Justicia, que han abordado este derecho en diversas sentencias, destacando las diferencias y similitudes en su interpretación. La falta de conocimiento sobre estos derechos impide a muchos trabajadores beneficiarse de las protecciones que ofrece la estabilidad laboral reforzada, creando un ambiente de precariedad. El ensayo concluye que, para garantizar la aplicación efectiva de este derecho, es fundamental mejorar la educación y divulgación sobre los derechos laborales, tanto en el ámbito educativo como en los lugares de trabajo.
The essay addresses reinforced labor stability for health reasons in Colombia, a right that protects vulnerable workers due to health problems.
