Resumen
El estudio tuvo como finalidad analizar cómo una propuesta de una guía digital podía contribuir a que los artistas emergentes evitaran desequilibrios en los contratos discográficos, fortaleciendo su comprensión sobre los derechos musicales y las entidades encargadas de su protección. Su alcance se centró en identificar los conceptos esenciales que los músicos deben conocer antes de firmar acuerdos y en examinar los vacíos de información que aumentan su vulnerabilidad jurídica. La metodología empleada fue cualitativa, basada en la revisión documental de SAYCO y ACINPRO, así como en declaraciones de artistas que habían enfrentado cláusulas abusivas. Los resultados mostraron que la asimetría de información persistió como el principal factor que llevó a los artistas nuevos a aceptar contratos desfavorables, junto con la falta de acompañamiento legal y la complejidad de los documentos institucionales. También se evidenció que muchos músicos desconocían diferencias básicas entre derechos autorales y conexos, lo que dificultaba su capacidad de negociación. En general, la investigación demostró la necesidad de herramientas claras, accesibles y pedagógicas para fortalecer la autonomía profesional de los artistas emergentes y promover relaciones contractuales más justas dentro de la industria musical.
The study aimed to analyze how a digital guide could help emerging artists avoid imbalances in recording contracts by strengthening their understanding of musical rights and the entities responsible for their protection. Its scope focused on identifying the essential concepts that musicians should know before signing agreements and examining the information gaps that increase their legal vulnerability. The methodology used was qualitative, based on a documentary review of SAYCO and ACINPRO, as well as on statements from artists who had faced abusive clauses. The results showed that information asymmetry persisted as the main factor that led new artists to accept unfavorable contracts, along with the lack of legal support and the complexity of institutional documents. It was also evident that many musicians were unaware of basic differences between authorial and neighboring rights, which limited their negotiation capacity. Overall, the research demonstrated the need for clear, accessible, and pedagogical tools to strengthen the professional autonomy of emerging artists and promote fairer contractual relationships within the music industry.
