Resumen
La Ley 2159 de 1852 estableció por primera vez en Colombia la necesidad de llevar
el registro de nacimientos, y asignó esta función a los notarios pero la legislación en
la materia ha evolucionado hasta nuestros días, tanto que a partir del decreto 1260
de 1970 se regulo este acto, que se puede hacer en forma extemporánea.
Los problemas sociales y políticos de Venezuela ha producido una masiva
migración de colombianos residentes allá y de venezolanos, quienes tramitan
permisos de trabajo o nacionalizan a sus hijos venezolanos de padres colombianos,
pero por las dificultades de los consulados , no pueden presentar documentos
originales apostillados, por lo cual la Registraduria Nacional del Estado Civil ha
venido registrando extemporáneamente a esos niños, con solo dos testigos hábiles
y documentos venezolanos sin apostillaje, con fundamento en la expedición de
varias circulares, que vencidas piden su prorroga el Ministerio de Relaciones
Exteriores y varias autoridades de control y organizaciones no gubernamentales.
