Resumen
Durante el desarrollo del presente artículo de investigación se propuso evidenciar y
analizar las problemáticas jurídicas que afrontan los migrantes venezolanos al momento de
acceder a la contratación laboral en Colombia, con ello se pudo constatar cómo algunos
empleador han manipulado el sistema normativo y han empleado a los migrantes
venezolanos indocumentados, ofreciéndoles una remuneración más baja de la que percibe
un Colombia del común y negándoles sus derechos inherentes e inalienables como
trabajador, además las jornadas labores para las cuáles son contratados son más larga que
las de sus compañeros, esto acuñado a la xenofobia que perciben por parte de algún sector
de la sociedad en particular cuando se trata de un empleo independiente.
Con el fin de indagar sobre dicho fenómeno migratorio ante la exclusión laboral
migratoria, se realizó una investigación desde un paradigma interpretativo, con un enfoque
cualitativo utilizando un método hermenéutico que ampliará el contexto jurídico y social por el
cual de atraviesan millones de venezolanos, algunos que hicieron tránsito por el país y otros que
se asentaron en él. Con el apoyo de revistar indexadas se amplió el panorama de ideas, al igual
que el informe de la ACNUR, donde evidencia que más de 6 millones de migrantes han partido
de su país.
Con el fenómeno migratorio en masa se logró determinar que sus condiciones laborales,
en ocasiones fueron menoscabadas por parte de los empleadores y para lo cual el Estado
colombiano implementó diversas políticas de inclusión y regulación normativa que
contrarrestaran dicha situación
During the development of this research article, the legal problems faced by Venezuelan migrants when accessing labor contracts in Colombia will be evidenced and analyzed, with this it was possible to verify how some employees have manipulated the regulatory system and have employed migrants. Undocumented Venezuelans, offering them a lower remuneration than what they receive in a common Colombia and denying them their inherent and inalienable rights as a worker, in addition, the working hours for the qualities the are hired are longer than those of their colleagues, this coined to the xenophobia that received by some sector of society in particular when it comes to self-employment. In order to investigate this migratory phenomenon in the face of migratory labor exclusion, an investigation was carried out from an interpretive paradigm, with a qualitative approach using a hermeneutic method that will broaden the legal and social context through which millions of Venezuelans go through, some of whom made transit through the country and others who settled in it. With the support of indexed magazines, the panorama of ideas was expanded, as was the UNHCR report, which shows that more than 6 million migrants have left their country. With the mass migration phenomenon, it was possible to determine that their working conditions were sometimes undermined by employers and for which the Colombian State implemented various policies of inclusion and normative regulation that counteract this situation
