Resumen
El Sistema de Gestión de Seguridad y Salud en el Trabajo (SG-SST) es normado en Colombia, por lo que es obligatorio su implementación y ejecución por parte de los empleadores. Cuando un el empleador se aleja de su papel de garante para que se desarrolle el Sistema de Gestión de Seguridad y Salud en el Trabajo en su empresa, surgen los accidentes y enfermedades laborales. Este documento desarrolla una investigación con enfoque cualitativo por medio de un diseño Hermenéutico, que busca analizar el panorama actual de los empleadores en Norte de Santander en el marco del Sistema de Gestión de Seguridad y Salud en el Trabajo (SG-SST) de sus trabajadores, que parte de identificar el marco normativo relacionado con la responsabilidad legal de los empleadores en el Sistema de Gestión de Seguridad y Salud en el Trabajo, además de explicar el papel que desempeña el empleador en el Sistema de Gestión de seguridad y salud en el Trabajo, y finalmente, mostrar las condenas Judiciales por culpa patronal en el Sistema de Gestión de Seguridad y Salud en el Trabajo (SG-SST) en Norte de Santander. En efecto, se encuentra que, en Colombia existe un amplio Sistema Normativo en Sistema de Gestión de Seguridad y Salud en el Trabajo (SG-SST),
además que el papel de los empleadores en el marco del Sistema de Gestión de Seguridad y Salud en el Trabajo es de Protección y de Seguridad para sus trabajadores, y finalmente se encuentra que, en Norte de Santander han existido eventos en Seguridad y Salud en el Trabajo fallados por la Corte Suprema de Justicia como Culpa Patronal.
The Occupational Health and Safety Management System (OHS-SG) is regulated in Colombia, so its implementation and execution by employers is mandatory. When an employer moves away from its role as guarantor for the development of the Occupational Health and Safety Management System in its company, occupational accidents and diseases arise. This document develops a research with a qualitative approach through a Hermeneutic design, which seeks to analyze the current panorama of employers in Norte de Santander within the framework of the Occupational Health and Safety Management System (SG-SST) of its workers, which starts from identifying the legal framework related to the legal responsibility of employers in the Occupational Health and Safety Management System, in addition to explaining the role played by the employer in the Occupational Health and Safety Management System, and finally, showing the judicial convictions for employer fault in the Occupational Health and Safety Management System (SG-SST) in Norte de Santander. Indeed, it is found that, in Colombia there is a broad Regulatory System in Occupational Health and Safety Management System (SG-SST), in addition to the role of employers within the framework of the Occupational Health and Safety Management System is Protection and Safety for their workers, and finally it is found that, in Norte de Santander there have been events in Safety and Health at Work ruled by the Supreme Court of Justice as Employer Fault
