| dc.description.abstract | El siguiente problema de investigación tiene como principio llevar más allá las perspectivas y retos del derecho constitucional y administrativo en cuanto a los quebrantamientos de las garantías constitucionales en adultos mayores durante el covid-19. Como objetivo general se tiene la de interpretar cuáles son las garantías constitucionales que se le vulneran a los adultos mayores frente al estado de excepción (covid-19) La presente investigación se justifica por que pretende indagar mediante un tema general aquellas vulneraciones que se han llevado a cabo contra los adultos mayores dentro de la pandemia y del confinamiento impuesto en el año 2020 a causa de fuerza mayor, La metodología que se utilizó en este artículo es el paradigma de investigación el hermenéutico histórico, con un el enfoque cualitativo, el método inductivo, el tipo de investigación descriptiva. La población y muestra son los diferentes textos y sentencia de la corte constitucional. la técnica del análisis de contenido de textos La principal conclusión es que en estos momentos el adulto mayor cuenta con todo el apoyo del estado, debido a su indefensión, el Estado es responsable de ser garante de sus derechos por ser parte de la población de mayor vulnerabilidad, así se encuentra establecido en diferentes textos manifestados y proferidos por la Corte Constitucional pero también se necesita una adecuada protección de las personas mayores es imprescindible la colaboración de la población joven y adulta. | spa |
| dc.description.abstract | The following research problem has as a principle to further the perspectives and challenges of constitutional and administrative law in terms of violations of constitutional guarantees in older adults during covid-19. The general objective is to interpret what are the constitutional guarantees that are violated to older adults in the face of the state of exception (covid-19) The present investigation is justified because it intends to investigate through a general theme those violations that have been carried out carried out against older adults within the pandemic and the confinement imposed in 2020 due to force majeure, The methodology used in this article is the historical hermeneutic research paradigm, with a qualitative approach, the inductive method , the type of descriptive research. The population and sample are the different texts and sentence of the constitutional court. the text content analysis technique The main conclusion is that at this time the elderly have all the support of the state, due to their defenselessness, the state is responsible for being the guarantor of their rights for being part of the elderly population vulnerability, as it is established in different texts expressed and proffered by the Constitutional Court, but adequate protection of the elderly is also needed, the collaboration of the young and adult population is essential. | eng |
