Resumen
El presente ensayo tiene como propósito analizar el impacto ambiental del
transporte marítimo: Responsabilidad ambiental de los estados con respecto a los
efectos de la contaminación. En cuanto a los referentes teóricos utilizados se
consultaron autores como Franco (2023), Itriago y Rivero (2021), Guzmán (2022),
Ariza (2020) y Beltrán (2019). El estudio como tal es de carácter documental
bibliográfico, donde, se consultó la normativa legal marítima relacionada a los
Convenios Internacionales Marítimos y estudios de Derecho Marítimo. El ensayo
concluye la idea de una gobernanza global que aborde cuestiones ambientales con
funciones esenciales para el desarrollo de un sistema internacional, presentado a lo
largo de este ensayo tiene la posibilidad de proporcionar información, propiciar un
espacio político adecuado con condiciones de negociación y capaz de afrontar lo
negociado de conformidad con los intereses globales. Del mismo, se debe coincidir
en la necesidad de resaltar el espacio para la resolución de grandes problemas,
colocándolos en el centro de un debate como es el caso del transporte marítimo
internacional y el marco regulatorio en materia ambiental para guiar las actividades
futuras al servicio del desarrollo social y económico, sin afectar el aspecto
medioambiental.
Asimismo, tendría un espacio de carácter político capaz de negociar sobre
cuestiones e intereses ambientales, dotado de una estructura para resolver
disputas, fomentando así la participación y desarrollando la reciprocidad, facilitando
la regulación y estandarización de los procedimientos legales a nivel mundial.
The purpose of this essay is to analyze the environmental impact of maritime transport: Environmental responsibility of states with respect to the effects of pollution. Regarding the theoretical references used, authors such as Franco (2023), Itriago and Rivero (2021), Guzmán (2022), Ariza (2020) and Beltrán (2019) were consulted. The study as such is of a bibliographic documentary nature, where the maritime legal regulations related to International Maritime Conventions and Maritime Law studies were consulted. The essay concludes the idea of a global governance that addresses environmental issues with essential functions for the development of an international system, presented throughout this essay has the possibility of providing information, fostering an adequate political space with negotiation conditions and capable of deal with what was negotiated in accordance with global interests. Likewise, we must agree on the need to highlight the space for the resolution of major problems, placing them at the center of a debate as is the case of international maritime transport and the regulatory framework in environmental matters to guide future activities at the service of the social and economic development, without affecting the environmental aspect. Likewise, it would have a political space capable of negotiating on environmental issues and interests, equipped with a structure to resolve disputes, thus encouraging participation and developing reciprocity, facilitating the regulation and standardization of legal procedures worldwide
