Caso Petro vs Colombia, aspectos procesales relevantes y sus consecuencias para la transformación del régimen disciplinario interno

Resumen
Una de las herramientas de mayor representatividad en las democracias actuales
es el voto popular, el cual se contempló en el artículo 258 de la Constitución
Política, como un deber y derecho ciudadano, que, al ser el método directo de
participación, debía ser protegido de cualquier coacción (Gobierno Nacional de
Colombia, 2016). Y la Corte Constitucional (2005) lo afirma por medio de la
Sentencia T-603/05, donde caracteriza el voto como la herramienta más
importante en el sistema electoral, que contribuye a la consolidación del proceso
democrático, a través de la organización la regulación y el control estatal, y como
un ejercicio de participación en el poder político (Hernández & Echeverri, 2018).
Bajo esta premisa del voto popular, se enfatiza en el entendido de que el pueblo a
través de este mecanismo, es quien elige al funcionario y que, debe ser la misma
ciudadanía la que ejerza una herramienta de control político (como lo puede ser la
revocatoria de mandato) cuando el funcionario elegido incumpla las funciones para
las cuales fue escogido, con la salvedad de que existen escenarios de carácter
administrativo y judicial que habilitan otro tipo de mecanismos de control y
aplicación de la ley que permiten la remoción de un funcionario público de su
cargo adquirido bajo mandato popular.
From the 1991 constitution and taking as a reference article 1 that establishes Colombia as “...a social State of law, organized in the form of a unitary Republic, decentralized with autonomy from its territorial entities, democratic, participatory and pluralistic. ..”, changes have been generated in the structure of the state (specifically in the branches of public power), so that this allows progress to be made in the consolidation of a democracy that is representative and at the same time participatory, strengthening the State, the Government and civil society. The central scenario of this writing is the interpretation from the field of procedural law of the events that occurred against the political rights of the then mayor of Bogotá and current president of Colombia, Mr. Gustavo Francisco Petro Urrego, who in 2012 was dismissed by the prosecutor's office headed by then-prosecutor Alejandro Ordóñez, alleging irregularities in the implementation of the new sanitation model in the city of Bogotá. The flagship program for the management of solid waste in the city of Bogotá was called "Zero Garbage", for which the district government headed by Petro developed a series of administrative adjustments through decrees, giving recyclers the possibility of office of being a direct part of the management and commercialization of the city's usable waste, through the formation of the public company wáters the Bogotá.
