Resumen
En este anteproyecto de investigación se fundamentan los antecedentes que le darán sostén y credibilidad a nuestra investigación.
Artículo titulado “Los contratos y convenios interadministrativo y las incidencias disciplinarias en la contratación directa”, por Joyce del Carmen Sanguinetti Peña, 2015. En este artículo el autor hace una reflexión a los fundamentos que rigen los tipos de Contratación en nuestro país, su incidencia disciplinaria, las consecuencias al no acarrear la no aplicación de los mismo, así como la de determinar cuáles son las posibles causas por la cual se sanciona a muchos servidores públicos en Colombia. Del mismo concluye que para poder conseguir los Fines del Estado en cuanto a la contratación se deben ceñir en la escogencia transparente, imparcial e independiente para que esta sea objetiva y realmente el personal que evalúa y contrata pueda cumplir a cabalidad con las necesidades de la administración y no se presentan arbitrariedades ni 13 escogencias subjetivas que tienden a favorecer intereses particulares de manera continua.
A continuación, se llevará a cabo una guía en cual se plantea la contratación con el estado en el `presente artículo.
Artículo titulado por Laura Reyes Yunis 2012. “Ley de Contratación administrativa: Reforma a la contratación estatal, Esta monografía, está planteada en forma de una guía explicativa sobre las modificaciones realizadas dentro de la contratación por parte del Estado contenidas dentro de la Ley 1150 de 2.007, mediante la cual se modifica el régimen de contratación pública en Colombia. De manera que en esta obra se realiza un análisis del proceso legislativo surtido por esta reforma, la cual logró materializarse después de serios intentos de modificación de las normas que rigen los contratos que celebra el Estado.
Las entidades que desdibujan la contratación directa en Colombia Peñaranda & Camargo (2015) Se observa el reconocimiento del marco jurídico dentro de la aplicación de contratación directa y los principios vulnerados dentro de la celebración de contratos a través de fundaciones, ONG, y personas jurídicas sin ánimo de lucro, siendo objeto de “presuntas irregularidades en el ejercicio de la función pública”, pues se presume, que el régimen debería cumplir con los principios de validez, eficacia y justicia, evitando la famosa “corrupción” y el “carrusel de contratación”.

It concludes that to achieve the Purposes of the State in terms of hiring, they must adhere to the transparent, impartial, and independent selection so that it is objective and the personnel that evaluates and hires can really comply fully with the needs of the administration. and there are no arbitrariness or subjective choices that tend to favor interests continuously. Next, a guide will be carried out in which contracting with the state is proposed in this article. • Article titled by Laura Reyes Yunis 2012. “Administrative Contracting Law: Reform to state contracting, this monograph is presented in the form of an explanatory guide on the modifications made within the contracting by the State contained within Law 1150 of 2007, through which the public contracting regime in Colombia is modified. So that in this work an analysis of the legislative process supplied by this reform is carried out, which managed to materialize after serious attempts to modify the norms that govern the contracts that the State celebrates. The entities that blur direct contracting in Colombia Peñaranda & Camargo (2015) The recognition of the legal framework is observed within the application of direct contracting and the principles violated within the conclusion of contracts through foundations, NGOs, and legal entities without profit motive, being the object of "alleged irregularities in the exercise of the public function", since it is presumed that the regime should comply with the principles of validity, efficiency and justice, avoiding the famous "corruption" and the "recruitment carousel".
