Resumen
El Estado frente a el conflicto armado interno el Colombia se propuso crear la ley 1448 del 2011,
conocida como la ley de víctimas y restitución de tierra, la cual es el instrumento por él se reparar
en forma integral las víctima de desplazamiento, despojo, abandono en miras de restablecer su
dignidad y sus derechos, teniendo por objeto establecer un conjunto de medidas judiciales,
administrativas, sociales, económicas, individuales y colectivas en beneficio de las víctimas que
sufrieron violaciones de sus derechos en el marco del conflicto armado. Estas medidas pretenden
hacer efectiva la reparación de víctimas del conflicto armado, así mismo el derecho a la verdad. El
objetivo del trabajo fue analizar la realidad en los proceso de reparación de víctima, ya que se
evidencia la problemática que suscitada necesidad de reconocer los actores que participan en este
confrontamiento desde una perspectiva restaurativa con énfasis en las victimas, al igual que
adelantar estudios que contribuyan en la evaluación critica no solo de los mecanismos ejercidos
en el desarrollo normativo dentro del proceso de reparación, sino en la gestión judicial y
administrativa practica de esta misma, específicamente desde la perspectiva regional que establece
un enfoque social y geográfico en las zonas de conflicto en el departamento de Norte de Santander,
con base en el análisis histórico y normativo que busca la identificación de los factores procesales
que permiten a las víctimas ser reconocidas y reparadas, adicionalmente, pretende aportar una perspectiva que procure la apertura del espectro de los formuladores de políticas públicas sobre
las barreras prácticas que enfrentan las políticas de atención y reparación de víctimas en zonas de
conflicto, esta investigación se desarrolló conforme a una metodología que expresa un paradigma
interpretativo que contribuye al análisis de textos que soportan la investigación y ayuda a
establecer la forma de recolectar los datos de los formalismos procesales para ser reconocido como
víctima, un enfoque cualitativo que emerge como la necesidad de abarcar problemas del conflicto
armado interno en Colombia, el Método Hermenéutico y complementando con una matriz de
análisis usada para analizar toda la información contenida en la investigación de una forma
digerible, entendible y estructurada, toda vez que queramos deconstruir la información para así
poder analizar una mayor cantidad de información documental, como resultado de la investigación
en cuanto al objetivo general los resultados muestran una gran deficiencia en el cumplimiento o
ejecución de las medidas complementarias a la restitución, que requieren la actuación de otras
entidades del Estado en el ámbito nacional y regional, y que son necesarias para que las víctimas
retornen en condiciones dignas y sostenibles, concluyendo así que el proceso de reparación integral
debe contemplar, entre sus bases fundamentales, la voz de las personas, familias y comunidades
que han sido víctimas, en el desarrollo de cualquier tipo de medida, ya sea jurídica, psicosocial, en
salud física, simbólica o económica.
In the face of the internal armed conflict, Colombia proposed the creation of law 1448 of 2011, known as the law of victims and restitution of land, which is the instrument for the comprehensive Compensation of victims of displacement, dispossession, abandonment with a view to restoring their dignity and rights, with the aim of establishing a set of judicial, administrative, social, economic, individual and collective measures in benefit of victims who suffered violations of their rights in the context of the armed conflict. These measures are intended to make effective the compensation of victims of the armed conflict, as well as the right to the truth. The objective of the research was to analyze the reality in the victim compensation process, since it shows the problems that arise from the need to recognize the actors involved in this confrontation from a restorative perspective with emphasis on victims, as well as carrying out studies that contribute to the critical evaluation not only of the mechanisms exercised in the normative development within the process of compensation, but also in the judicial and administrative practical management of the same, specifically from the regional perspective establishing a social and geographical approach in the conflict zones in the department of Norte de Santander, based on the historical and normative analysis that seeks to identify the procedural factors that allow victims to be recognized and repaired, additionally, it aims to provide a perspective that seeks to open the spectrum of public policy makers on the practical barriers faced by policies for the care and compensation of victims in conflict areas, this research was developed according to a methodology that expresses na interpretative paradigm that contributes to the analysis of texts that support the investigation and helps to establish the way to collect data of procedural formalities to be recognized as a victim, a qualitative approach that emerges as the need to cover problems of the internal armed conflict in Colombia, the Hermeneutic Method and complementing with na analysis matrix used to analyze all the information contained in the research in a understandable and structured way, whenever we want to deconstruct the information in order to analyze a greater amount of documentary information, as a result of the research on the overall objective, the results show a major deficiency in the fulfilment or implementation of measures complementary to restitution, which require action by other State entities at the national and regional levels, and that they are necessary for victims to return in dignified and sustainable conditions, thus concluding that the process of comprehensive compensation must include, among its fundamental foundations, the voice of the individuals, families and communities who have been victims, in the development of any kind of measure, whether legal, psychosocial, physical, symbolic or economic.
