Los términos para la aplicación de la prescripción de multas de tránsito con resolución de cobro coactivo: ¿tres o cinco años?

Resumen
En el transgredir de las actuaciones administrativas nos encontramos con
innumerables situaciones que presentan controversias entre la administración y el
particular, una de ellas es la que traemos a colación en el presente escrito.
El plazo de prescripción de las multas de tránsito es de tres años a partir de la fecha
de imposición de la multa, es decir, transcurrido el plazo de tres años, la persona pública
está obligada a notificar oficialmente el plazo de prescripción de la multa. Este plazo de
prescripción puede ser interrumpido por una orden de pago o una decisión de cobro
forzoso, que es la autoridad estatal de cobro para las violaciones mencionadas. El meollo
del asunto es ahora saber si, ¿Los términos son de cinco o de tres años para que prescriba la
sanción en cobro coactivo? En este escrito desarrollaremos y resolveremos el concerniente
interrogante que en ocasiones ha presentado alteraciones entre entidades públicas y el
presunto infractor.
In the transgression of the administrative we find innumerable situations that present discussions between the administration and the individual, one of them is the one that we bring up in this writing. The prescription of traffic fines has a term of three years counted from the sanctionable act, that is, after these three years, the entity has the obligation to officially declare the prescription of said fine. However, this limitation period can be interrupted by a resolution of coercive collection, which is the power that the administration has to exercise collection of said infraction. The crux of the matter now is to know if, is it five or three years for the fine in coercive collection to expire? In this writing we will develop and resolve the respective question that has sometimes presented alterations between public entities and the alleged offender.
