Responsabilidad objetiva del estado producto de muerte a causa de demoras en vacunas por COVID – 19 en Colombia

Resumen
La pandemia trajo consigo diferentes consecuencias en el mundo, entre ellas consecuencias jurídicas, puesto que, alteró diferentes sistemas normativos, como por ejemplo el ámbito de responsabilidad de los Estados, creando nuevas obligaciones en materia de salud colectiva, prevención y organización. De allí que por recomendación de la Organización Mundial de la salud, se dijo que existían diferentes tipos de vacunas para combatir la pandemia del COVID-19, dando unos tiempos determinados para sus respectivas dosis; Colombia ha ido modificando en muchas oportunidades los tiempos determinados por los laboratorios para primera y segundas dosis, de igual manera imponiendo que vacuna se debe aplicar una persona en su mayoría de las veces sin exámenes previos, de ahí que, se plantea que si hay consecuencias negativas por las anteriores situaciones, las familias de las víctimas podrían iniciar una demanda en contra del Estado por reparación directa, siendo el principal objetivo de este artículo analizar cuál sería el ámbito de responsabilidad aplicable para estos casos, conforme a las jurisprudencia del Consejo de Estado. Tratándose entonces, de un enfoque de investigación cualitativo, desde un diseño hermenéutico con el que se realice un análisis legal.
Es por esto que es pertinente desarrollar primeramente los tipos de responsabilidad contractual o extracontractual del Estado en materia de salud en Colombia que podrían llegar a existir, seguido de los posibles eventos adversos producto de la vacunación por covid-19 en los participantes del Plan Nacional de Vacunación, para así concluir con el análisis del estudio, el cual demuestra que en cuanto a los eventos adversos puede existir una responsabilidad objetiva y en cuanto a la demora u omisión de la aplicación de vacunas puede existir una falla en el servicio. Y de esta manera se evidencia la importancia del presente escrito, ya que la cantidad de muertes o afectaciones en la salud que se causaron a un gran número de colombianos irían ligadas a esa responsabilidad objetiva o falla del servicio encabezada por el Estado.
The pandemic brought with it different consequences in the world, among them legal consequences, since it altered different regulatory systems, such as the scope of responsibility of the States, creating new obligations in terms of collective health, prevention and organization. Hence, by recommendation of the World Health Organization, it was stated that there were different types of vaccines to combat the pandemic of COVID-19, giving specific times for their respective doses; Colombia has been modifying in many opportunities the times determined by the laboratories for first and second doses, in the same way imposing which vaccine a person should be applied in most of the times without previous examinations, hence, it is proposed that if there are negative consequences for the above situations, the families of the victims could initiate a lawsuit against the State for direct reparation, being the main objective of this article to analyze what would be the scope of responsibility applicable for these cases, according to the jurisprudence of the Council of State. It is therefore a qualitative research approach, from a hermeneutic design with which a legal analysis is carried out. This is why it is pertinent to first develop the types of contractual or extracontractual liability of the State in health matters in Colombia that could exist, followed by the possible adverse events resulting from the vaccination by covid-19 in the participants of the National Vaccination Plan, to conclude with the analysis of the study, which shows that in terms of adverse events there may be a strict liability and in terms of the delay or omission of the application of vaccines there may be a failure in the service. And in this way the importance of this paper is evidenced, since the number of deaths or health affectations caused to a large number of Colombians would be linked to this strict liability or failure of service headed by the State.
