Resumen
En el mundo, y de la mano de la globalización han surgido nuevas formas de trabajo, algunas consideras controversiales socialmente, como es el modelaje Webcam, en Colombia es una actividad que se ha vuelto habitual pero esta no cuenta con una normatividad jurídico laboral que garantice los derechos de las personas que lo ejercen, dejando al arbitrio de los estudios webcam la modalidad de contratación a escoger, lo cual genera una desigualdad ante el trato que se le da a otras personas que ejercen un trabajo bajo la formalidad y cuentan con los mismos elementos en cuanto a la realidad y a la hora de ser contratados.
Sin embargo, como estado social de derecho, Colombia propende por salvaguardar los derechos de las personas, sin dejar excluido a nadie, evitando discriminación y sin importar la actividad que se ejerza, siempre y cuando sea una actividad lícita. Por ello surge el deber de regularse bajo una normatividad jurídica que sea realmente acorde y se ajuste a lo que la realidad dicta de un empleo más que crece exponencialmente en el país, el cual deja muy buenas ganancias y una alta tasa de divisas.
