Resumen
La migración es un fenómeno social que data desde los inicios de la humanidad, nació de la necesidad del ser humano por buscar comida, mejores condiciones de vida y luego con el tiempo fue la solución para huir de las guerras civiles, la hambruna, las enfermedades y muchas otras situaciones adversas. Así como la migración evoluciono, los estados también tomaron medidas o controles al ingreso de los migrantes que inicialmente eran vistas con medidas restrictivas por su contundencia en las regulaciones pero que con el tiempo han tomado aristas más humanizadas gracias a los diferentes organismos internacionales y a las legislaciones locales que han intervenido para avalar los derechos humanos de la personas que se encuentran en proceso de migración. Esta investigación implemento una metodología de revisión bibliográfica a partir de la indagación de artículos científicos que tienen peso conceptual en el tema de estudio. Se pudo concluir que existen posturas críticas y flexibles con respecto a los controles migratorios y que cada país ha adoptado la legislación internacional con modificaciones o adaptaciones según los tipos de migración que se presentan, garantizando los derechos humanos de los migrantes.
Migration is a social phenomenon that dates from the beginning of humanity, was born from the need of the human being to find food, better living conditions and then over time it was the solution to escape from civil wars, famine, disease and many other adverse situations. As the migration evolved, the states also took measures or controls on the entry of migrants who were initially seen with restrictive measures due to their forcefulness in the regulations but that over time have taken more humanized edges thanks to the different international organizations and laws premises that have intervened to guarantee the human rights of people who are in the process of migration. This research implemented a literature review methodology based on the investigation of scientific articles that have conceptual weight in the subject of study. It could be concluded that there are critical and flexible positions regarding migration controls and that each country has adopted international legislation with modifications or adaptations according to the types of migration that are presented, guaranteeing the Human rights of migrants.
