Resumen
La presente investigación, tuvo como objetivo analizar jurídica y conceptualmente la forma cómo se ha legislado en torno a la protección ambiental en otros sistemas jurídicos, respecto al caso colombiano; se propuso como objetivo general: analizar el derecho comparado en torno a la protección ambiental respecto al caso colombiano; el paradigma utilizado fue interpretativo bajo el enfoque cualitativo, y de naturaleza documental, el estudio del problema fue con el propósito de ampliar y profundizar los conocimientos, con apoyo, principalmente, en trabajos previos, información y datos divulgados por medios impresos, audiovisuales o electrónicos; también fue de tipo descriptivo porque consistió en la caracterización de un hecho, fenómeno, individuo o grupo, con el fin de establecer su estructura o comportamiento; y la investigación estableció de carácter explicativo, porque se encarga de buscar el porqué de los hechos mediante el establecimiento de relaciones de causa y efecto. Se concluyó que todos los países adscritos a los diferentes organismos internacionales encargados del cuidado y protección del ambiente, tienen su marco normativo que regula la materia del ecosistema
The objective of this research was to analyze juridically and conceptually the way in which legislation has been legislated around environmental protection in other legal systems, with respect to the Colombian case; It was proposed as a general objective: to analyze comparative law regarding environmental protection with respect to the Colombian case; the paradigm of the methodology used was a qualitative approach, and of a documentary nature, the study of the problem was for the purpose of broadening and deepening knowledge, with support, mainly, in previous works, information and data disseminated by print, audiovisual or electronic it was also descriptive because it consisted in the characterization of a fact, phenomenon, individual or group, in order to establish its structure or behavior; and the research established an explanatory nature, because it is responsible for looking for the facts through the establishment of cause and effect relationships. It was concluded that all the countries assigned to the different international organisms in charge of the care and protection of the environment, have their normative framework that regulates the matter of the ecosystem
