Resumen
La culpabilidad e imputación objetiva en el marco del proceso penal y el Sistema penal acusatorio suponen un reto para la aplicación de justicia efectiva en el Estado social de derecho, el principio de inocencia y la protección de los derechos humanos, han hecho de la imputación y decisión judicial un asunto jurídico, ético, político, mediático y por supuesto científico. En este artículo se realiza un análisis bajo los enfoques de imputación objetiva, adentrándose por las corrientes positivistas del derecho penal, entendiendo los componentes del Sistema penal colombiano y la valoración de la prueba como garante de la decisión en derecho y las garantías del acusado en un Estado social de derecho. Así mismo, se consideran las capacidades subjetivas y objetivas del juez desde la perspectiva científica del proceso penal como parte de la complejidad objetiva del proceso penal y su espectro decisorio.
The guilt and objective accusation in the framework of the criminal process and the accusatory criminal system pose a challenge for the application of effective justice in the social State of law, the principle of innocence and the protection of human rights, have made the imputation and judicial decision a legal, ethical, political, mediatic and of course scientific issue. This article analyzes the approaches of objective imputation, entering the positivist currents of criminal law, understanding the components of the Colombian penal system and the evaluation of the evidence as a guarantee of the decision in law and the guarantees of the accused in a Rule of Law. Likewise, the subjective and objective capacities of the judge are considered from the scientific perspective of the criminal process as part of the objective complexity of the criminal process and its decision-making spectrum.
