Resumen
Las políticas criminales tienen entre sus ámbitos más importantes la prevención del delito y la
humanización del sistema penitenciario y carcelario en Colombia. Este trabajo centra su estudio
en la importancia que tiene la prevención del delito y la reinserción social de las personas
privadas de la libertad con el respaldo de políticas criminales que fundamenten su propósito en
programas que busquen satisfacer de capacitación, educación, salud, cultura y deporte. Esta
investigación busco analizar la Política Criminal Colombiana frente al cumplimiento de
Reinserción Social, en la Población Privada de la Libertad en Situación Jurídica Condenada al
Interior del Complejo Carcelario y Penitenciario de Media Seguridad de Cúcuta. Bajo un enfoque
cualitativo y un paradigma interpretativo, la metodología empleada busco comprender que la
realidad es dinámica y diversa dirigida al significado de las acciones humanas, la práctica social,
la comprensión y significación. Por tanto, los resultados evidencian que la acción disciplinaria
penal en relación con la política criminal tuvo mayor garantía y aplicabilidad, además de cambios
que se han hecho en la legislación tienen un impacto directo en este caso, en la efectividad de
estas políticas. Se concluye así que, el gobierno colombiano trabaja en soluciones para abordar
estos problemas, pero los desafíos siguen siendo inmensos. Desde el acceso a la educación y las
oportunidades laborales hasta el apoyo a la salud mental para los afectados por el conflicto, hay
muchas áreas que requieren una inversión y una acción sustanciales para lograr una reintegración
social significativa para todos los colombianos
One of the most important areas of criminal policies is crime prevention and the humanization of the penitentiary and prison system in Colombia. This work focuses its study on the importance of crime prevention and social reintegration of persons deprived of liberty with the support of criminal policies that base their purpose on programs that seek to satisfy training, education, health, culture and sports. This research seeks to analyze the Colombian Criminal Policy regarding the fulfillment of Social Reinsertion in the population deprived of liberty in legal situation sentenced inside the Medium Security Prison and Penitentiary Complex of Cúcuta. Under a qualitative approach and an interpretative paradigm, the methodology used sought to understand that reality is dynamic and diverse directed to the meaning of human actions, social practice, understanding and significance. Therefore, the results show that the criminal disciplinary action in relation to the criminal policy, had greater guarantee and applicability, in addition to changes that have been made in the legislation have a direct impact in this case, in the effectiveness of these policies. Thus, the Colombian government is working on solutions to address these problems, but the challenges remain immense. From access to education and job opportunities to mental health support for those affected by the conflict, there are many areas that require substantial investment and action to achieve meaningful social reintegration for all Colombians.
