Plan nacional de política criminal 2021-2025 y su efectividad en la reintegración social en el marco del cumplimiento de los fines de la pena

Resumen
Este trabajo apuesta por el abordaje de la configuración del Plan Nacional de Política Criminal frente a las garantías proteccionistas mínimas de una persona que se encuentra privada de la libertad, en tanto su proceso de reintegración social y el cumplimiento de los fines de la pena, con el objetivo de evaluar su aplicabilidad y funcionamiento efectivo. Para ello, se tendrá como referencia el principio de dignidad humana y otras disposiciones entorno a los Derechos Humanos. El enfoque es de tipo cualitativo de carácter documental y descriptivo basado en el pronunciamiento más reciente de la Corte Constitucional Colombiana al respecto. Se propicia la utilización de fuentes digitales de información con dicho propósito. Las conclusiones nos aproximan que, la política criminal debe velar por las condiciones favorables de vida de los penados a fin de promover su correcta reincorporación y resocialización, es decir, existe un rol activo del Estado en esta dinámica.
This work is committed to approaching the configuration of the National Criminal Policy Plan against the minimum protectionist guarantees of a person who is deprived of liberty, as long as their process of social reintegration and compliance with the purposes of the sentence, with the objective of evaluating its applicability and effective operation. For this, the principle of human dignity and other provisions related to Human Rights will be taken as a reference. The approach is qualitative, documentary and descriptive based on the most recent pronouncement of the Colombian Constitutional Court in this regard. The use of digital sources of information for this purpose is encouraged. The conclusions bring us closer to the fact that criminal policy must ensure favorable living conditions for convicts in order to promote their correct reincorporation and resocialization, that is, there is an active role of the State in this dynamic.
