Resumen
La presente investigación se realizó justificados en el derecho animal, derecho civil y derecho constitucional ya que a pesar de que existen leyes en Colombia con la idea de proteger los animales, hay un vacío enorme ya que muchas veces no se cumplen y no se aplican de manera efectiva, sin contar que hay áreas que aún no cuentan con una legislación clara y especifica que permitan proteger a los animales de manera segura. Situaciones que llevan a los abusos y maltratos hacia los animales, sin que exista una sanción efectiva para los responsables.
Y surge la pregunta de como ¿Cómo se debería analizar la posición de la Corte Constitucional frente a la exequibilidad de las normas que consideran a los animales bienes animados en Colombia? no obstante en Colombia existen leyes que regulan la protección de los animales e identifican a los animales como seres sintientes, como, por ejemplo, la ley 84 de 1989: Esta ley establece las normas para la protección de los animales domésticos y su regulación en el país, la ley 746 de 2002: Esta ley establece sanciones por maltrato animal, incluyendo el maltrato a perros. Sin embargo, muy a pesar de que existan estas leyes el código civil colombiano los sigue identificando como bienes muebles animados, acá abarca una duda si en realidad los animales son seres sintientes o son bienes. Recientemente según decisión de la corte suprema de justicia los animales de compañía pueden ser embargados, donde analizamos lo anteriormente dicho y entra en duda en los que en realidad es un animal en Colombia, una problemática que hasta el momento no ha tenido solución, siendo una problemática que afecta a los animales y a toda la sociedad debido al incumplimiento de las normativas existentes para la protección y bienestar animal.
Como objetivo de investigación es profundizar más la situación de los derechos de los animales en Colombia ya que es preocupante que los animales sean considerados legalmente como bienes muebles, lo que significa que no tienen derechos legales específicos y, en muchos casos, se les trata como objetos sin sentimientos ni necesidades dando como resultado, que los animales puedan ser maltratados, explotados y sacrificados sin consecuencias legales significativas.
Encontrando maltrato y abuso, comercio ilegal de animales, experimentación animal, falta de educación, sin embargo, se pueden tomar medidas para mejorarla. La creación de leyes y regulaciones, la promoción de la educación, la adopción. La legislación colombiana relacionada con los derechos de los animales, incluyendo las leyes de protección animal y las disposiciones sobre propiedad y bienes muebles ayuda a comprender el marco legal en el cual se considera a los animales en Colombia y si se reconoce su condición de seres sintientes, al igual que la ética y la filosofía también juegan un papel importante en el análisis de este tema, la opinión pública y la conciencia social sobre el trato a los animales es un factor importante en el análisis.

And the question arises as to how should the position of the Constitutional Court be analyzed regarding the enforceability of the norms that consider animals animated goods in Colombia? However, in Colombia there are laws that regulate the protection of animals and identify animals as sentient beings, such as Law 84 of 1989: This law establishes the rules for the protection of domestic animals and their regulation in the country, Law 746 of 2002: This law establishes sanctions for animal abuse, including the abuse of dogs. However, despite the fact that these laws exist, the Colombian civil code continues to identify them as animated movable property, here there is a question whether animals are actually sentient beings or are goods. Recently, according to a decision of the Supreme Court of Justice, companion animals can be seized, where we analyze what has been said above and what is actually an animal in Colombia comes into question, a problem that until now has not had a solution. being a problematic that affects animals and the whole society due to non-compliance with existing regulations for animal protection and welfare. The objective of the investigation is to go deeper into the situation of animal rights in Colombia, since it is worrisome that animals are legally considered movable property, which means that they do not have specific legal rights and, in many cases, they are treated as objects without feelings or needs resulting in animals being mistreated, exploited and slaughtered without significant legal consequences. Finding mistreatment and abuse, illegal animal trade, animal experimentation, lack of education, however, steps can be taken to improve it. The creation of laws and regulations, the promotion of education, adoption.
