La efectividad del sistema penal en casos de acto sexual violento contra mujeres adultas en la ciudad de Barranquilla durante el 2021

Resumen
La violencia sexual es un suceso que se ha presentado desde hace siglos atrás, siendo una problemática que sigue vigente en el presente año. Los casos frecuentes de violencia sexual son muy recurrentes, según un estudio realizado en Latinoamérica se estima que solo el 5% de personas agredidas denuncian a sus agresores ante las autoridades competentes (Organization, 2005) .Y en la mayoría de casos el género que se ve más afectado por esta situación es el femenino, según un estudio realizado por la OMS en 161 países durante el 2000 y el 2018 una de cada 3 mujeres (30%) han sufrido de violencia física y/o sexual siendo su pareja el agresor.
Debido a la situación sanitaria del COVID 19 dio lugar al aumento de casos de violencia sexual tras el confinamiento al aumentar el tiempo de contacto entre parejas y disminuir el contacto social y el tiempo para que las victimas recurran a instituciones que ayuden a resolver el conflicto entre ellos.
Uno de los casos más vistos sobre violencia sexual es el acto sexual violento, regulado por el código penal colombiano art 206 y se diferencian del resto de delitos sexuales por el no requerimiento de coito o penetración estos sucesos se desarrollan por medio de actividades, tales como, tocamientos, caricias, besos o manipulación de las partes íntimas de la víctima, caracterizados por su contenido libidinoso y le caracteriza violento por el uso de violencia por medio de elementos o amenazas que perjudiquen la integridad física de la persona (penal, s.f.). Solo en Barranquilla se presentaron 25 casos en el 2021 de actos sexual violento en mujeres adultas (Colombia, 2022) de las cuales todos fueron perpetrados por hombres y solo se legalizaron la captura de 3 individuos según los resultados operativos de la policía nacional (Colombia, 2022). Por esta razón, el presente artículo de investigación tiene como finalidad Analizar la efectividad del sistema penal en casos de acto sexual violento contra mujeres adultas en la ciudad de Barranquilla durante el año 2021.

Frequent cases of sexual violence are very recurrent, according to a study conducted in Latin America it is estimated that only 5% of assaulted people report their aggressors to the competent authorities (Organization, 2005). And in most cases the gender that is most affected by this situation is the female, according to a study conducted by WHO in 161 countries during 2000 and 2018 one in 3 women (30%) have suffered from physical and/or sexual violence being their partner the aggressor. Due to the health situation of COVID 19 resulted in the increase of cases of sexual violence after confinement by increasing the contact time between partners and decreasing social contact and time for victims to resort to institutions that help resolve the conflict between them.. One of the most frequently seen cases of sexual violence is the violent sexual act, regulated by the Colombian penal code art 206 and differing from other sexual crimes by not requiring intercourse or penetration, these events are developed through activities such as touching, caressing, kissing or manipulation of the victim's intimate parts, characterized by their libidinous content and characterized as violent by the use of violence through elements or threats that harm the physical integrity of the person (Penal, n.d.). In Barranquilla alone there were 25 cases in 2021 of violent sexual acts in adult women (colombia, 2022) of which all were perpetrated by men and only 3 individuals were legally captured according to the operational results of the national police (colombia, 2022). For this reason, the purpose of this research article is to analyze the effectiveness of the penal system in cases of violent sexual acts against adult women in the city of Barranquilla during the year 2021. nal justice system to cases of sexual violence against women in Barranquilla during 2021 has been insufficient and ineffective, which represents a challenge for the authorities and society in general. In addition, it highlights the importance of strengthening access to justice and support for victims of sexual violence.
