Resumen
El presente artículo tiene como propósito principal analizar de qué manera se garantizan los
derechos humanos a los migrantes venezolanos que han sido víctimas de la crisis
humanitaria, social y política de su país dentro del contexto de la normativa colombiana, con
el fin de generar una discusión social y jurisprudencial desde el punto de vista de teóricos que
sostengan o estudien el tema en cuestión; lo anterior mediante la metodología descriptiva en
la cual se generaliza el problema por medio de características claves de la población y la
muestra, utilizando un paradigma hermenéutico interpretativo fijándose como punto clave la
situación precaria en la que viven los venezolanos en Colombia.
Para encontrar resultados veraces en la investigación será usada la normativa colombiana, la
cual se ha acoplado efectivamente a la problemática de los migrantes, ya que por medio de la
Corte Constitucional se han hecho notorias las garantías de los derechos fundamentales y
derechos humanos a los que son merecedores a pesar de no encontrarse en su país de origen.
En conclusión, se piensa concretar por medio de los resultados las posibles premisas
arrojadas desde la perspectiva hermenéutica de los derechos de los migrantes venezolanos y
la observación de las entidades encargadas de garantizarles a ellos los derechos humanos
consagrados en los tratados internacionales que fueron acogidos por el Estado colombiano.
The main purpose of this article is to analyze how human rights are guaranteed to Venezuelan migrants who have been victims of the humanitarian, social and political crisis in their country within the context of Colombian regulations, in order to generate a discussion social and jurisprudential from the point of view of the theoreticians who support or study the subject in question; the foregoing through the descriptive methodology in which the problem is generalized through key characteristics of the population and the sample, using an interpretive hermeneutical paradigm, setting as a key point the precarious situation in which Venezuelans live in Colombia. In order to find truthful results in the investigation, Colombian regulations will be used, which have been effectively coupled to the problem of migrants, since through the Constitutional Court the guarantees of fundamental rights and human rights have been made known. they are deserving despite not being in their country of origin. In conclusion, it is intended to concretize through the results the possible suspicions raised from the hermeneutical perspective of the rights of Venezuelan migrants and the observation of the entities in charge of guaranteeing them the human rights enshrined in the international treaties that were accepted by the Colombian state.
