Resumen
Los call center constituyen una fuente de trabajo importante en Barranquilla y, en
general, en todo el país. Existen distintas formas de vinculación, que en algunos casos
corresponden a extensión de la misma empresa, es decir, empresa subsidiaria de una matriz
y, en otros, a empresas totalmente independientes, que venden sus servicios de
comunicación a otras empresas, en cuanto tiene que ver con su operatividad empresarial.
Una revisión bibliográfica sobre los call center y su operación en general, permite
determinar algunos aspectos en los que se evidencia una deficiente sujeción a las normas
laborales que aplican en Colombia, en detrimento de la calidad de vida de los trabajadores y
en relación con la inobservancia de deberes patronales consagrada en las mencionadas
normas. Las deficiencias que se observan en Colombia guardan relación con las que se
denuncian en otros países, tal como se menciona en el cuerpo del trabajo y ello lleva a la
conclusión de que, si bien son una feliz novedad como generación de empleo, son, por otro
lado, empresas que requieren de la vigilancia y control de los organismos estatales, para
garantizar a los trabajadores, ya sean tercerizados o contratados bajo la modalidad de
teletrabajo, el mínimo de derechos consagrados en la Constitución y la ley. En el presente
trabajo se analizan críticamente tanto las condiciones de vinculación laboral como los
riesgos laborales, que se pueden presentar a quienes trabajan en la modalidad de teletrabajo
y quienes brindan sus servicios directamente en los call center, en el Distrito de
Barranquilla.
