Resumen
El presente proyecto de investigación, pretende Determinar si existe protección del estado frente al derecho de no discriminación de mujeres embarazadas en la alcaldía de la ciudad de barranquilla del año 2022 al 2023. El artículo 27 de nuestra constitución política de 1991 establece que todas las personas son iguales ante la ley y tiene derechos a igual protección. No habrá discriminación por motivo de nacimiento, nacionalidad, credo político, raza, sexo, idioma religión, opinión, origen, posición económica o condición social.
Al interpretar esta amplia definición del Sistema surge nuestra pregunta de investigación que es la siguiente: ¿Qué protección brinda el Estado frente al derecho de no discriminación de mujeres embarazadas en la ciudad de barranquilla durante los años 2022 al 2023? Para la solución de esta, los estudios fueron realizados bajo los lineamientos del paradigma histórico hermenéutico, con un tipo de investigación cualitativa. Consta de tres capítulos, el primero, donde hacemos alusión a la evolución histórica de las regulaciones frente a la violencia contra la mujer en su forma de discriminación laboral. En el segundo capítulo frente los derechos que se afectan a las mujeres embarazadas cuando el empleador no las quiere tener en su puesto de trabajo, por su condición, los cuales están organizados en orden Constitucional en donde dependerá de las condiciones de la trabajadora y de los derechos que más se le ven afectados en su desarrollo profesional, en donde todos son importantes pero que sin duda unos se presentan más que otros cuando se habla del vació jurídico frente al incumplimiento de la reglamentación de la no discriminación en mujeres embarazadas. Y por último un tercer capítulo denominado percepciones de las mujeres embarazadas que trabajan en el sector público y privado frente a la protección de sus derechos fundamentales y de no discriminación., donde se utilizó la técnica de las encuestas; realizadas a 13 trabajadoras embarazadas de la Alcaldía, de la población Barranquillera con contrato de prestación de Servicios o sin él que constan de seis preguntas cerradas. Los datos analizados recalcan la existencia de un persistente vacío jurídico que ha durado muchísimos años y aún no ha sido resuelto, en primera medida nos dispone que las mujeres trabajadoras embarazadas, así como pueden tener la condición de embarazo son discriminadas. Concluimos que los datos estudiados demuestran que el derecho que más se vulnera sea el derecho a la seguridad y
salud en el trabajo, puesto que es uno de los derechos que se vulnera con mayor facilidad, ya que a pesar de que la norma categoriza el derecho a la salud y el derecho al trabajo como uno de los derechos fundamentales vemos como el mismo estado es quien se encarga de violentarlos. Situación que agrava el vacío jurídico debido a que lleva a sentir que no hay seguridad jurídica o sea que la trabajadora se sienta desprotegida y pierda la credibilidad ante los funcionarios y personas escogidas algunas por voto popular y otras por meritocracia que no les interesa llevar a cabo una igualdad entre la población afectada.
This research project aims to determine if there is state protection against the right of non-discrimination of pregnant women in the mayor's office of the city of Barranquilla from 2022 to 2023. To solve this problem, the studies were carried out under the guidelines of the historical hermeneutic paradigm, with a type of qualitative research. It consists of three chapters, the first, where we refer to the historical evolution of regulations against violence against women in its form of workplace discrimination. In the second chapter, we deal with the rights that are affected by pregnant women when the employer does not want them in the workplace, due to their condition, which are organized in Constitutional order where it will depend on the conditions of the worker and the rights that are most affected in their professional development, where all are important but undoubtedly some are presented more than others when talking about the legal vacuum in the face of non-compliance with the regulations of non-discrimination in pregnant women. And finally, a third chapter called perceptions of pregnant women who work in the public and private sectors regarding the protection of their fundamental rights and non-discrimination, where the survey technique was used; made to 13 pregnant workers of the Mayor's Office, from the Barranquilla population with or without a Service provision contract, which consist of six closed questions. The data analyzed highlights the existence of a persistent legal vacuum that has lasted many years and has not yet been resolved. First of all, it tells us that pregnant working women, as well as those who may be pregnant, are discriminated against. We conclude that the data studied demonstrate that the right that is most violated is the right to safety and health at work, since it is one of the rights that is most easily violated, since despite the fact that the norm categorizes the right to health and the right to work as one of the fundamental rights, we see how the state itself is responsible for violating them. Situation that aggravates the legal vacuum because it leads to feeling that there is no legal security, that is, the worker feels unprotected and loses credibility with officials and people chosen, some by popular vote and others by meritocracy that they are not interested in carrying out. equality among the affected population.
