Resumen
El derecho laboral, se presenta de acuerdo a la modalidad de afiliación laboral. Toda vinculación de trabajo queda determinada y vislumbrada en las pautas del artículo 22, presenta a fin de que “Acuerdo, comúnmente se da por a través de un texto, por el que dos o más partes se comprometen recíprocamente a respetar y cumplir una serie de condiciones de trabajo; contrato de alquiler”. Por tal razón, el presente artículo también se apoya en los reglamentos colombianos plasmados en la constituyente de 1991, en el artículo 53. En dicho artículo, garantizó el derecho al trabajo, la paridad y las condiciones, derecho a recibir un salario según las labores realizadas, con condiciones favorables para el trabajador.
Para algunos trabajadores colombianos, el tipo de contrato tratado en la actualidad, desnaturaliza el empleo, pues, estos establecen estos, dejando a un lado las verdaderas condiciones en las cuales se debe desempeñar los trabajadores, además, se observa que muchos, evaden sus obligaciones como contratantes, provocando el detrimento económico y la inestabilidad (tanto laboral, como física, económica, familiar y social) de los trabajadores.
En el presente trabajo se crea un análisis a partir del marco legal, basándose en la filosofía laboral, el análisis histórico del comportamiento laboral en Colombia, además, se pretende buscar los efectos que tiene la jurisprudencia laboral en la sociedad, presentándose como el único soporte legal sirviendo como base principal para los juristas, en tal caso se utilizan y referencian los fallos de las Altas Cortes que se han tomado como precedente
Labor law is presented according to the modality of labor affiliation. Any linkage of work is determined and envisioned in the guidelines of Article 22, presented in order that "Agreement, commonly occurs through a text, whereby two or more parties agree reciprocally to respect and comply with a series of working conditions; rental contract". For this reason, this article also relies on the Colombian regulations embodied in the constituent of 1991, in article 53. In this article, guaranteed the right to work, parity and conditions, right to receive a salary according to the work carried out, with favorable conditions for the worker. For some Colombian workers, the type of contract dealt with today denatures employment, since they establish these, leaving aside the true conditions in which workers must perform, besides, it is observed that many evade their obligations as contractors, causing the economic detriment and instability (both labor, physical, economic, family and social) of the workers. In the present work an analysis is created from the legal framework, based on the labor philosophy, the historical analysis of the labor behavior in Colombia, in addition, it seeks to find the effects that labor jurisprudence has on society, presenting itself as the only support legal service serving as the main basis for jurists, in which case the judgments of the High Courts that have been taken as precedents are used and referenced
